    reos

    i am in a bad situation they told me if i volutary the truck then it wont be bad, but if they have to go futurther then it will be amess seen. we are onlky 2 months behind, and at this time. they told me when they come take it then they acution it off and i owe for the rest. well we voluntarty it but my son went in the hospital , but now they said that in reverted back, i not ready to take the truck yet to i see if i lose this battle of being sue by the school. which in long words my son suppose of done something and there no proof. soif i let them repo it how olong before i would have to file? or how long before they come for the rest of the money?i just in a bined and not sure what to do i have every thing falling on me. how much time do i have to file before i cant go bankrupty? thanks stres out mom

    It doesn't matter if your Repo is Voluntary or Involuntary. If there is a balance left after they auction it, they will balance bill you.

    If you are 100% certain that you will file for Chp 7 BK, they stop paying all your discrentionary bills, and start saving as much money as possible. The moment you stop paying your debts, you will need to stop using all forms of credit too. Just wait six to nine months to file for BK.

      repo, then todd please help

      then let me ask this should i try to hold on to this vehicke as long as i can like hiding it till i can file? and how long will it take them to come after me? the other thing you didnt answered is i have a civil suit against me that my handicap child suppose to broke and no proof but there still take me to court which is in june a pre trail, so that why i try to find out if i should wait and hide the truck and see if i loose the battle, any suggestions? please help! thankk you for an ear!

        1). Hiding your vehicle for months on end without making any payments, wont help your chances of getting a reaffirmation under bankruptcy. You should start looking for another car that you can purchase CASH, while you're "holding" on to your present car, or pay half of your monthly car payments if you can afford to do so.

        2). If you are found guilty of the "destruction of property" charges, and you cannot afford to pay the costs, then list the debt on your Chp7 petition. But first consult with an attorney in your state to ensure that it can be included in your petition. You could probably get the majority of your questions answer, during the "Free" Initial Consultation.

          my wife had the same problem with letting her car go 5 years ago. trust me, they really do not want the vehicle as much as they want the money, anyway, it took months for them to repo the car, we finally got tired of their phone cars, so we called them and told them where it was. The balance started $7,500, now its something like $15,000 5 years later, they must think we are going to pay 30% in late fees per month or something, how stupid some of there loanshark companies are, well its been 5 or 6 years now and she hasnt even filed BK, in another 1-2 years, it will fall off and not bother her anymore, the car company has of yet to do anything, and if they havent done anything by now, then i doubt they will or it will be much harder for them, if they was serious about getting their money,they should have filed against her shortly after, we even tried to settle at one point for $3-5k
          they refused, I said OK, get nothing then. they could have had something, but they made their choice of getting nothing. it was one of these loan sharking companies they actually loan credit to people who have bad credit.
