    What is the law?

    What's the law reguarding a vehicle that is still sitting in my yard? I tried Chapter 13 with the vehicle on the plan,but things didn't pan out.Anyway I got my lawyer to amend the plan and I gave up the vehicle. I got all the paperwork saying that the court granted my request.This was six(6) months ago.Are they going to let it rot in my yard or will they come get it? If the don't want it,then I'll be glad to take it.So,what's the law on the time that the leinholder has to come get the vehicle? Or is there a law? I would want my property back if it was me,but I'll be gald to take it from them if they don't want it. By the way I'm in Georgia.

    Hi,

    Typically if a vehicle is not recovered within 90 days, it is considered as being abandoned. Have you contacted the lien holder, about this?

      No,I have not talked to the leinholder on this issue.It's there property,if they want it I figure they will come get it. On the other hand I think I will call my lawyer,just to see what the law is.Like I said,if they don't want it,I'll sure take it!

        Mitch, I hope you get to keep it! That would be cool. I had one creditor come to my creditor's meeting about a four-year-old dishwasher and living room suit. Supposedly they were going to take those items back and said they'd contact me to make the arrangements, so I left them sitting in my old house, which I am also forfeiting in the bankruptcy. No one has contacted me about arranging to get these items and I am about to be discharged. I think they decided it wasn't worth their time! Meanwhile I've replaced all my living room furniture with stuff from a church thrift store. Oh well, I like this furniture better anyway. ;) Might see about going back for the dishwasher, though, before they take possession and change the locks on the house. If I leave it there and the finance company decides they want it AFTER the mortgage company takes possession of the house, (unlikely) then, hey, I'll just have to tell them "Talk to the mortgage company. They have it now, out in the house."
