Pacer after the 341

First question:

Why does it seem like bankruptcy attorneys do not mention this online service to us when we are filing bankruptcy?

i.e. I mentioned it briefly when I was asking my lawyer's secretary a few questions about what to bring to the 341 before I started reading this board...she sounded extremely surprised that I mentioned Pacer and I felt stupid for mentioning it.

second question:

ok. Now that I can see that the trustee wants my 4Runner, if they succeed, vehicle may come with new dents, burns, chocolate, etc...when it leaves home...

I will need to liquidate one IRA, which I don't have any issues doing...it will pay me $100 a month at age 59....well, I'm 43 and I need the 8K that will be left over after paying the 30% to IRS & fed taxes for a new vehicle, to say the least...when my car goes bye-bye. 341 was yesterday....I have another fund I'm not touching...so I still have a retirement nest egg....

Thoughts?

Depends on how fast they get it entered. My info was the the day after the 341.

When and how did they inform you that they want your 4 runner?
I have an asset case (filed chap 7 Jan '05 and still going on) and no one has told me anything or asked me anything about surrendering my assets. There was some creditor that filed claims as of the end of Oct.
Any help or ideas???

My 341 was 11/15...the trustee hasn't said that he wanted it yet...it is my only asset. I was trying to show that the necessary repairs are half the price of what the truck's currently worth and then with my $1k exemtion...we're in the $2,500 neighborhood.....going to check the Pacer site a little later this morning...I don't know if it would be on Pacer and/or would the trustee notify my attorney if they want the truck?

You filed in January and are still not discharged?? What's up with that?

Your lawyer must not be to informed?? WHY would he think average Joe couldn't look at Pacer?? It is PUBLIC record info....fishy response to me??
I mentioned to our lawyer that I checked Pacer and she said "oh good, we were going to send you the info about that."

When we gave back our car..it had a huge crack in the windshield (we didn't didn't , yet we never had it fixed either ).We took everything detachable from it. We had put new tires on it 7 months earlier, and we took those off, and put cheap ones on it my neighbor had. We took the spare, the jack, rugs, cargo net, and misc..my neighbor even siphoned (sp?) the gas out of it, heck our neighbor gave us money for all of it ....We didn't care the car company, and they didn't say anything either!!

As far as Pacer... when I called the attorney's office to bring to their attention that the incorrect creditor's mailing matrix was attached to my filing, one attorney was "tremendously surprised" that I could access Pacer.

Two weeks later when I called again because the error had not been rectified, the lead bankruptcy attorney's wife, an attorney herself, asked me why I was accessing Pacer. She went on a bit indigently asking if I was taking this up as a profession or if I were a paralegal!!! I told her no.

I went on to say that I frequented several BK support group boards that recommended checking Pacer in order to access your own case to check its progress, etc.

That seemed to satisfy her questioning. She just said that in 25 years of her husband practicing bankruptcy law that they have never had a client mention the use of Pacer and that really it wasn't a bad idea... it just surprised them!

They have been in business since 1980, four attorneys, eight offices handling bankruptcies, Personal Injury, Family Law, Criminal Law, Living Trusts and Evictions.

I sure wish I would have had to opportunity to meet her husband, the one with 25 years bankruptcy experience, as they way she handled some of my issues were certainly was not to my satisfaction.

I guess as long as the trustee does not question what was filed before discharge, then I will have to be satisfied!

Sorry if I wasn't clear. We received our discharge back in May. In May, Pacer listed it as "no assets" even though it was filed with assets.
Then in June we received a "Notice of recovery of Assets" giving creditors until the end of Oct to file claims which many of them did. One even did it twice. lol I am not sure whats next.
Back in Aug, pacer showed that the Trustee filed an Interim Report for period ending 6/30 but the report is not in file, says "Trustee will provide copy to interested parties" I think I've read somewhere that the interim report list assets and amounts? Not sure. If anyone knows, please share.
As far as the assets, I don't know what they want, nor when or where they want them. There are a few things I would like to "buy back" if possible.
All I know for sure is that I am getting real tired of all this & just want it behind me. I had no idea it would last this long. Maybe they are waiting for Xmas so I can gift wrap everything for them. LOL
My hat is off to Minnie. Don't know how she does it.

Wow! We've got an asset case, because of a seller-financed mortgage they are taking from us. After you get your discharge, are you able to get on with your life, buy and sell as you like, etc.? Or is the BK still hanging over you like before discharge?

You didn't say if you had an attorney or whether you filed pro se.....??

You said you had assets, but you don't know what they are and what they are talking about taking??

Did you reaffirm on your home, or own it free and clear??

Are you driving an expensive vehicle or own one free and clear that's worth money to the trustee?


You need to request a copy of the Interim Report that the Trustee filed, then you will know exactly what assets they are after.

Your sounds like its been a wild case too......believe me, they show no mercy of any kind......

I filed in June 2004, discharged in October 2004, but case is still open and pending due to house issue. Home will be sold on auction block Dec 3rd..... and not a thing I could do about it...... I have fought since day one....

Hope yours is over soon, as you know it can be very nerve-wrecking and hard to deal with after a while.

After discharge its back to "normal life" again if your case is over and closed.

Then you can buy, sell, or give away whatever you want......

Just remember though, at any given time within 1 year of discharge, the trustee can reopen your case if he wishes with a petition to the court.

So if you win the lottery, or inherit a lot of money, HE WILL DEFINETLY be around to visit again.

Most never do though.....
