    Going the Ch7 route, have questions

    I'm currently overseas and won't return until 06/2005 for about a month and wanted to ask the forum a few questions. Can anyone tell me what my options are being away from home?

    Do I have to be physically present for any of the process?
    Can I appoint a POA to represent me?
    I'm behind on a few CC accounts, do all of them have to be past due?
    My car is current, how long will it take them to take it back once I stop the payments?
    How important is timing and is there really a step by step process to all of this?
    Does anyone know how it works in AZ (Tucson)?
    As you can see that I'm still in the worried stage of my decision and I'm just ready to get out of where I'm at and start fresh. Your help is greatly appreciated.

    Hi,

    Yes you can have/use a POA. However, because you know your personal finances best. You could simply stop paying on debts, and file for bankruptcy when you return to AZ. It isunt uncommon to let debts default over a year or two, prior to filing for bankruptcy. You'll just need to keep abreast of your creditors collection efforts, so that you can react accordingly, in the event that they attempt to garnish your wages to pay your debts.

      I filed in Tucson in 1994. The 341 was like a bankruptcy "mill" with about 30 filers in the room sitting on folding chairs. The trustee called out our names and read each of us an identical statement and set of questions. I don't think he looked up at us once. He spent 1 minute MAX on each person in alphabetical order. Once he was done addressing you, you were permitted to leave.
      In case you make it to the 341, walk over to The Barrio and treat yourself to the caramel custer. It is TO DIE FOR!
