    I need some help!!!

    I'm so worried I feel like the world is coming down on me right now the last few years has been terrible...........didn't really start bothering me until I had a heart attack at 39 then the bills starting rolling in then reality set in, then everything around me went to pieces.........I had insurance which pay a lot of it but I still had to pay out of pocket deduct. that's when I started using my CC more just didn't have any extra money left for other things.

    I need some advice.........I don't know where to start....I have all these questions to ask I hope nobody minds repeating some of the information to me I'm pretty sure others has ask the same things.

    Anyways I owe around $16,000 with my CC........ since the CC laws came into effect at the beginning of the year making my payment double I'm force to file.......was going to start paying more after my car was paid off which will be in about 2 years but I can't since the CC payments will almost take all my check. I have other bills to pay like my car payment, some medical bills etc...can't make those if I pay the CC bills.

    Anyways I'm current on all my bills as of right now but that will change very soon (like this month.)
    What do I need to do first?

    What I'm wanting to do is file BK13 with those CC is this possible? If I file BK13 will this go against my future credit?

    Will it effect my husband's credit? both CC's are in my name only........He doesn't even know about this yet.........he will probably kill me!!!

    I read somewhere that you shouldn't (have) used your cards in 60 days what does that mean???? I haven't use it since Dec. 23rd 2005 (not quit 60 days)

    Also how soon do I need to get a lawyer after I stop paying my CC or should I get one ASAP? When will they try to garnish my wages? Will a lawyer prevent that from happening?

    set up appts with many attorneys and ask them. its free and most everything will be answered after that.

    you dont start out wanting to do a ch13. ask the attorneys about a ch7 first. yes a 13 and a 7 both go against you thte same way. just cuz you pay some doesnt mean squat bascially.

    if those credit cards are not tied to him in any way then no it wont effect him. but of course he should know.

    the court looks at recent charges within 90 days and can also be longer then that, as potential abuse. once you know you are going to file you must stop using your cards.

    not sure one has anything to do with the other. you should consult attorneys right away but dont pay anything until you learn more. once you pay it becomes on record that you wanted to file. anything charges past that point can easily be considered fraud.

    When will they try to garnish my wages?

    no idea. its up to the creditor. first they have to sue you and get a judgement.

    Will a lawyer prevent that from happening?

    no he wont. retaining an attorney will not stop anything. you have to file the bk petition then it stops.

    also, if its only 16K total then maybe you can work out deals with the CC companies. depends on everything going on in your life. only you know. most people that file have way more then that.

      you should consult attorneys right away but dont pay anything until you learn more. once you pay it becomes on record that you wanted to file. anything charges past that point can easily be considered fraud.

      Sorry I'm slow.......LOL....Once you pay it........what does that mean? are ya talking about paying a lawyer or paying on your cards?

        paying or putting down a retainer for the attorney. that date goes on your bk petetion.

              Once you hire your lawyer how long does it take him/her to file a petition?

                all depends on the attorney, his business at the time and how long it takes you to geet all the information completed, reviewed, corrected and filed.

                usually less then 30 days. but that is a rough guess. too many factors.

                ask your attorneys when you meet with them for the free appts.
