Thanks for the update-Sinkingfast! I was wondering how you were doing!
Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

I went to Pacer and checked on cases she's filed. Not a lot compared to "Smith" who does the most in town and is cheapest. I did look to see if she's filed any new ones since 10/17 and she hasn't.

I looked a couple of the later ones she represented to check on expenses she's filed for. One couple had a $400/mo cell phone bill. "Smith" wanted to dink me from $130 down to $95, and the lady attny has filed for much higher on Schedule J.

"Smith" also flatly wouldn't allow us to include my Mom as a dependent. He said we might tread into the area of them wanting to include her income. The lady attny didn't think her income was a consideration. Another attny said the same thing in a phone consult. The lady attny even quoted one of the statutes/rules about other sources of income having to be used for the common support of the household. Phone consult attny specifically referenced a rule regarding dependent children's income not going to the common support of the household. Boy oh boy, if we get to use all 6 people on the Means Test for income purposes, we'll easily be UNDER the median!! And it will really help with the Gov't numbers from the Census data that we can enter for Food and such. WooooHooooo!!

I am not an attorney. My comments are based on personal experience and research. Always consult an attorney in your area to address concerns related to your particular situation.

remember that its the trustee and their relationship with the attorney that will be a large factor in how the case is handled if expenses are 'out of line'.

Just my opinion, and I don't know that it counts, but if they include the social security income, you also should get to deduct her medical expenses... Same for the son & his extra expenses.
