    File now or wait?

    Hi

    My exwife and I share some debt plus each have our own debt. We tried filing jointly prior to divorce, but that did pan out.

    My question is-she is planning to file on her own in the next week or 2. I know that she will have her joint and solo debt discharged, which makes me soley responsible for all joint debt.

    My real question is-should I wait until her bk is complete to avoid any confusion on joint debt, or can I file before hers is complete?

    I don't think there will be any issue with 'confusion'. When a person files, they include anything they are responsible for. Does not matter if the debts are joint or solo - if her name is on them, they'll be discharged.

    When you can or should file really depends on your situation. Time to assess your income, expense, etc. and take care of yourself.
    Get mortgage modified: DONE! 7 months of back interest payments amortized, payment reduced over $200/mo
    (In the 'planning' stage, to file ch. 13 if/when we have to.)
