    I would go ahead and file jointly, that is assuming, of course, that you intend to stay married. It would probably be more to your advantage, even if you were planning a divorce. A married person can file individually but of course, this will only serve to relieve one spouse of debts and still gives creditors the right to come after the other spouse for remaining balances. Particularly if you're in a community property state (not sure which ones are and which ones aren't), the trustee can seize property, I think even if it's solely in the name of the non-filing spouse. So basically, you haven't accomplished much if you're still married but you've only relieved one spouse of having to be responsible for debts. A free consulation with a lawyer in your state could answer this for sure. Some of them that advertise on the web even have toll-free information lines and don't mind answering a few questions for free. Just put "bankruptcy" into your search engine and you will probably find some firms that give out free advice. Good luck
