I talked to my dad about the lien thing and he said "yeah i guess we could like write up a contract saying you owe us this much blahblah" (which technically they did buy the car for me.. but I am supposed to repay them later on down the road.. just never had a contract more of an agreement).

    You've all been great help .. I know I have so many questions.. just different things ponder in my head at times and I'm wondering..hmm maybe that will work.
    Every time I've registered vehicles in a new state, I just give them the old state's title, and then they ask exactly how I want the names to appear on the new title. I usually go Hubby's name or my name. That way only one of us has to sign the title to sell/trade/whatever. That's when you would tell them your name, mom's name, and dad's name. Then all 3 of you are equal partners on the car title, legally speaking. If the motor vehicle clerk questions you, explain you are a student, Mom and Dad actually own the car, and now they want their names on the title. One of our titles had our names spelled wrong and I corrected that on the new state's title when I registered our vehicles. The clerk didn't even bat an eyelash. She just entered the info the way I wanted and told me how long to expect before we rec'd the new titles in the mail.

    Changing titles won't attract the attention some other ventures might. When people move, they have to register their vehicles in the new state. That's just a normal thing associated with a move to another state.

      Well, I guess I could do it that way. Florida's insurance will probably cost me more though DAMNIT! Oh well. I will definately try that avenue out sounds logical to me. Do my parents have to be there at the dmv to sign or can I just do it and say my parents own the car (because they are a few hours away from me). Thanks!

        Hubby's never been there with me when I've registered vehicles, and visa versa. The motor vehicle clerks generally don't question what you want done. Especially if you can check their boxes and jump thru their hoops. Proof of insurance, taxes paid, or whatever their requirements are. As long as the clerk can go down their list and say "Yup" got that, "Yup" got that, they don't seem to care too much about anything else.

            you better figure out if this is illegal transfer of assets before you do it.

              Whoa!

              I was thinking you would do the title work, wait for that to come back from the state, let some time pass and the dust settle, and then file.

              The attnys told me it would have been OK, that's what I shoulda done sort of thing, when I was registering vehicles last fall.

              If you transfer title and file same day, or within a short period of time, that might raise some eyebrows. Def find out from an attny if it won't constitute fraud first before proceeding.

                Well yeah, I'm definately going to ask an attorney and give him these certain scenarios with it. Hopefully something will come up that is legal. I'll make sure I'm not doing anything illegal I assure you that. With the new laws, you have to wait 10 years on a transfer of title thing to not be considered fraudulent anymore..according to one attorney. So there has to be a way where its not considered fraudulent. If anything hopefully the lien way. or title way like you suggested

                  also, remember that what you tell your attorney can not be changed. he is an officer of the court. once you tell him what your exact situation is he will not let you write the petition differently. keep this in mind.

                  if you already had a written contract that stated you owe X amount to your parents and it was dated back on the day you transfered title from your parents going into this situation then that could be asked about.

                  going forward from there the attorney can suggest what to do. if he deems that you dont need a contract then your parants can rip it up. if he deems it necessary that they need to be on the title in some form then you didnt know and that can be changed. etc, etc.

                  try to pick an attorney that didnt tell these things. also, what you say to them can be reported to the court. you do not want to lie.

                  having said that, if they do put their name on the titel as lien holders does that mean the lien was not perfected since it wasnt done 10 days within the date of the contract?

                  remember that damn thread where we couldnt get any answers about it? lol dont get me started on that one. its a sore spot still haha.

                  if the lien in unperfected then the trustee can take the vehicle.

                  OH THE HELL WITH IT, CRASH THE DAMN THING OUT OF RAGE AND get the check from the insurance and go to the bahammas and enjoy your life

                    Well we never had a written contract saying 'you owe me this much for the car paid by whenever..because obviously they are my parents and it was more of an oral agreement' I guess one could argue that to be false or not if they really wanted to.

                    I was thinking that as well, I'll just keep the keys in my car ( i mean i am from alabama my dad actually does that haha ) maybe someone will come steal it. Or maybe I'll just sell the car and by 8 grand worth of lottery tickets and tell the trustee I was hoping to hit the lotto so I could pay my creditors back..I'm sure they'd love it!

                            Under your breath that is. This is a touchy area, You may could borrow against the car to catch up bills, pay attorney,etc. But you to keep receipts, use the money for living expenses,etc. You also have to keep up the car payments after that.

                                I wouldn't run anyways, so looks like your not getting any reward money anytime soon .. out of me at least :P .

                                This thread has lasted way longer than I imagined..hopefully I'll be able to clear it alllllll up tomorrow. If not maybe I'll buy a Desert Eagle and tell the trustee to let me keep the car! haha jk. There has to be a way around it..and once we find out I think I'll post it on everywhere so threads don't have to go on for so long. lol
