    Repod car suit

    Well, I have this other long thread going on about my current car situation. However, I had a car a while back that did get repod (and thats one reason im filing bankruptcy). I have never received any information on how much they sold the vehicle for and what not. So tonight I decided to call them again (last time they never called me back).

    They sold the vehicle for I think it was around 29k and some change. I don't remember how much I owed, but I still owe 15k and some change..so you can do the math it was around 44k. (I'm an idiot for financing a car that cost that much but hey that's the past). I love how they sell the vehicle for so cheap as well, I really need to find these type of auctions in the future.

    Anyways so I was talking to the guy who was handling my situation on it, he was very nice by the way, (he said the company that he was doing it for is very picky and he figured I probably wouldn't pay becuase of the fact that they are just too damn picky..but it was his job).

    We had a nice 30 minute conversation about how shitty these people are, it was actually pretty funny.

    ANyways, he was saying that the best he could get it down to was probably 7500 that I would owe to them (if i wanted to pay it). He said they it leaves him and goes to the attorney at the end of the month. The attorney fees and court costs to sue me added an extra 2500 bucks to the plate lol if it gets to that point and they get the judgment.

    So basically my question is( and sorry for the long post) if they do sue me...I get a letter from the sheriff saying I am sued and they just get a default judgment (remember I have no assets).. then there is really nothing against me right? If I file BK I can get that judgment waived with the BK filing. Hopefully I will get my current car situation figured out and file before they get a chance to get a judgment on me.

    this will be a short thread. trust me.

    if you are in bk stay protection then you can not be sued. you list the debt owed then it will be discharged. if it is discharged then you no longer owe the debt.

    if you dont start the bk petition before you get served with papers, then all you do is show the court the bk petition and that case is put on hold.

      And if they get the default judgment.. and I file the BK petition say a month later I can still get that debt discharged right? Just wanted to be clear on it.

        sure. but they might put a lien against you. if that happens before you stop the civil suit then you would also have to get teh lien removed during the BK process after the 341 usaully. costs an extra $300-$400 during the BK and that plus $220 or something to reopen the bk case afterwards.

        why not try to work out settlement terms with them, in the mean time. that would show a good faith pattern lol and stall them,

          lol well he said they would take it down to 7500 (he said im an authorized user on some credit card ..assuming my moms .. that I could put it on that.. i was like uhm I doubt she would like that one..but let me talk to her and see..just to stall her a few days)

          That was after this other lady called me from american express trying to tell me if I file bankruptcy that I'll never be able to get a 'professional job' because I filed bankruptcy. Silly people

            did you ask her if thats what happened to her job?

            did you tell her that you were thinking of filing bk? if so then make sure you dont charge anything else from now on. also, telling them these things will only get them to stop working with you and possibly take it straight to civil court. never tell them that. they wont work with you any differentely anyways. stange, but they wont. always tell them what they want to hear to string them along.

              I told her she was an idiot. The bill was 200 dollars from Dillards..and I dont even remember having it.. but either way.. I said if you honestly think people don't hire you because you've filed bankruptcy then you are just weird.

              They honestly think people don't research or know anything about anything! Which I am sure some don't but jeez. Most companies don't hire you if you have TONS of debt because of the fact you will be more focused on that than your job. However, even then they still may hire you.. they just want you to fix it somehow. I told her no wonder unemployment rate is so high sometimes because so many people file bankruptcy they can't get a job! I laughed, then she hung up. I did tell her I was possibly filing though. Oh well if they sue me for 200 bucks go for it
