    Posts: 2 Question regarding closing/income tax being taken.

    --------------------------------------------------------------------------------

    Our income taxes were ordered by the trustee to be turned over to our attorney at our 341 meeting. My question is..(since our attorney evades most requests for information), does this have any bearing on the case closing? Does the taxes have to be turned over and distributed before the case will close? We are 29 days and waiting for closing to take place!!
    Thanks for any information!

    the debts themselves will still proceed to dsicharge and that is what you are most concerned about. close is a different matter.

    the case will discharge but will stay open as long as the trustee thinks there is some money to be had. in your case the taxes. as soon as he gets the taxes then you case should close shortly after that or at the normal close, whichever is greater.

      did you already have your 341 meeting? what date?

      when is your discharge scheduled to take place?

        We filed 9/9, 341 meeting on 10/11, discharge on 12/19. We are waiting for the closing due to other matters that are pending. This stuff is so nerve wracking that sometimes I'd rather have paid on the debts until I'm 70 rather than through this awful trauma.

          yes, if the trustee wants the income taxes then the case wont close until he gets it. you already got your discharge it sounds like so whoo hooo! you are done and already know the outcome. relax and enjoy yourself. get the taxes to him and let him do his greedy bastard thing.

            I am in the same boat. I was discharged and closed in the same day. Is that possible? I have a letter of discharge (2 pages) and then another letter stating case closed. So am I in the clear to keep my tax return. There was no mention of this in the 341 and I hate to call my attorney and ask him because no attention is better than getting attention in this situation. Any thoughts?

              yes you are done. if no one ever asked you about it then it seems that he doesnt want it.

              anything can happen of course but the case wont close if he wants the tax refund.
