Here's a thought. Sell the car. Cash the check and keep it in cash. Spend it anyway you like - after all it's your money until someone says otherwise. You really don't have to spend it wisely although it would be better if you did. If you spent it all in one night buying rounds for the house, there isn't much they can do about it. You have no income, posessions, checking account, etc. so you're pretty bullet proof after the car is gone. Let the atty for the other car sue you and get judgement - doesn't matter. Drag it out as long as you like - the longer the better if you are going to waste the money. Then file bk long enough before graduating so no one can try to impute future income into your bk.
Lastly, vow to never get into this kind of mess again. My 2 cents.

Yeah, I guess I could spend it any way I like..but it is my parents money haha so I'm sure they'll want me to spend it on something so they dont feel like they are wasting more money on buying me ANOTHER car. So once I cash it I don't have to keep receipts of where the money went? Just as long as I keep as receipt of me selling at 'fair market value'. Still cant get ahold of the attorney
Oh and I won't ever get myself into this situation. I was just an idiot, I didn't know about negative equity.. lets just put it like that.. had 5 vehicles last year.....and you can go from there. Then trying to get out of THAT situation used credit cards and what not so yeah kinda piled up. Oh well guess we'll see.

Just talked to him and as I thought I do have to use all of the money BEFORE filing..then I can file whenever I want .. just keep tabs on what I use the money for. I can use the money to pay him as well which is good.. he said he charges 1100.. court costs and all ... good price? Seems to be around here so I dont know. Guess I better get to my credit counseling class tonight haha.
Oh and yeah he said you can't use it to pay back parents loans or anything lol. So I won't be doing that. I'll invite you all over to a nice barbeque by the pool... and I am in Florida..and my aunt lives on the beach so we'll go there too.. finest cuts you can find!! ;)

You're young and have a bad financial history - no one is going to expect you to all of a sudden become a good money manager. Most people spend cash and don't keep receipts. If you don't know how to do this, then give the money to me and I'll show you how it's done.

Just kidding. I asked him about those scenarios and he said it would still be fraudulent..for whatever reason I didn't argue. I'm fine with selling it and getting something else.. I'm the type that likes getting new vehicles a lot anyways.. HENCE THE BANKRUPTCY TO BEGIN WITH! So now I just have to keep my self in line until I make the big money. Yeah I can spend the cash without receipts..but bleh I'll just play it safe and keep receipts for the bigger stuff.
Is his price fair? For attorney fees

There is a way to do what you are saying that would protect the vehicle. The only problem is since they are an insider, the trustee would surely contest it. If they let the judge decide, it becomes either a win or lose. Not saying the trustee would ultimately win but he would leverage his position to get them to fork up some cash. Well considering I am a law major lol I did try to go into west law(has every case you can think of..statutes for each states..etcetcetc.) I couldnt really find much pertaining to my situation. So in the end maybe I could contest it but I just want to be 100% sure I won't be out of the money. My parents would kill me :P
