    will your income allow for chapt 7? will you be no asset?

        Yes, no asset. That's why I'm waiting as long as possible. They cannot take anything from me since I don't own any non exempt property. I'm over the median but with allowed expenses and my health & disability insurance expenses the test has me at positive $42 per month and my actual expenses are around the same.

        I just want to see how other cases in my area turn out before taking the plunge. Don't want to be a lab rat with these new laws

          i wouldnt want to be positive $42. i would want to be negative $200. keep looking for exenses you have missed. you dont need to be a 'see how cheap i can live' hero. if one expense is stripped by the trustee then you may end up in chapt 13.

            also, if you are in the position to wait a total of 18 months from the last charge then i would say that would be ideal in almost any situation. it sounds like this may work for you as you also want to see how cases progress with the new law.
