      Yes it does suck. What's even more frustrating is she doesn't care to do anything about it. We postponed our wedding so I can get through the bk without her. Now I'm thinking we should get married and go bk together. Her added exemptions would actually help me on the means test. She doesn't care. She doesn't want to bk - a typical stuborn woman.

        I just got off the phone with Chexsystems:

        No website as of now, they are getting a new one?

        Anyways the rep pulled up my account, and I am still in Chex... I informed him of my BK discharge and they told me to send them a copy yo dispute the account. However here is the kicker, even if the bank (TCF) says "correct she was discharged from the balance", the account itself is still valid. Reason being the I was reported was for NSF activity...whether or not I owe a balance is not the issue, the REASON is the issue...that sucks!!! So I said what is the use of sending them anything?? It shows:

        "ChexSystems has no debt information available. May we suggest that you contact the source of the information to determine whether or not a debt is owed"


        So Chex doesn't even know weather I owe or not, and that is not the issue anyways. The bank TCF (scumbags...did I mention that?) reported for the type of activity not the DEBT!!! That makes me mad!

        So to make a long story short...I asked, so how long does the info stay on Chex. He said it is 5 years from the date that a bank reports to Chex, not the date that the account was closed. So say if you have an account and it gets closed on say...1/25/02 due to NSF, HOWEVER the bank does report it until say 11/25/05...the 5 years START at the 11/25/05 date, that is a crock!! So I would suggest you call and get a report for free and check you dates.

        Good luck...also there are MANY banks that do not use ChexSystem, it's just a matter of doing a tedious search. Some banks will open an account if you go in person armed with your discharge papers, and a nice opening balance, even though you are in ChexSystem.

                Pink, thanks for the info. From what chexsystems told my fiancee the only way to get the NSF's off of her is to pay - even if she went bk and even though it was not her writing the checks.

                She has a savings acct (which I guess is permitted) at a savings and loan but can't have a debit card or checking acct. Basically she has to go to the S&L and pay all her bills with money orders. What large banks don't require a good chexsystems rating? I heard Wachovia? - any others?

                    No see that is my point ....even if you DO pay them...they will stay on her report!!!! I had one account I paid along time ago, and it was still on there even though I PAID it. It is the "NSF label" that haunts you for 5 years.....not so much the amount owed!!
                    That's why this time I said screw it and filed bk, and am just waiting the stupid 5 years.

                    So basically:
                    ~if you pay they stay on for 5 years... then fall off
                    ~ if you DO NOT pay, they still stay on for 5 years and then fall off
                    so save yourself the money...LOL

                    Telecheck will remove the account from your report once it is paid or satsified...... NOT ChexSystem!!!

                        Hum......gave it back on Monday. sorry forgot to update you.
                        It was the best situtation, since we can temporary use my parent's car...so now we have no car payment or insurance payment. We can put all that money aside for a down payment, already have $1500 saved. Just waiting for the credit reports to report correctly now.

                            NO NO NO...we owed still on it. That's why I didn't want to put more into it. Sorry if you had the wrong info. Thanks for your help and info.
                            Heck if we owned it I wouldn't have complained about having to pay to fix it up.
