    Purchase Car Before Filing Q

    Hi, have a question for the resident experts:

    We met with our attorney last week, and determined that we will have to wait until at least Nov. 1 to file our Ch.7. This was due to having 2mo where my husband was paid 3 times, thus substantially affecting the average income. Waiting til Nov. will mean that there will only be 1mo where he got paid 3 times and we should pass the means test.

    However, he said that as we would only barely pass the means test, we should consider adding to our expenses to make doubly sure we do pass it. His suggestion was that we should consider replacing our paid-for 13y/o car with a newer car, giving ourselves a new payment in the $200 or so range. Does this make sense to any of you? Should we be worried that it would appear suspect that we are spending around $13/$14k one month before we file Ch. 7? Or would it appear reasonable to the trustee to replace a vehicle of that age?

    Also, would it be ok if we sold our 13y/o car to my mother, instead of using it as a trade-in?

    We purchased a car about a month before we filed as we knew our paid-off 10 year old car wasn't going to last long, and we were just barely passing the means test/expenses without a car payment. We had no questions/problems with our car purchase. FYI-we bought a late model used car for 10K.
