hi i have about 40 k charged on my credit cards, and they are in my name only, is my wife liable for these if i file bankruptcy, single even though i used her income on my credit cards application,we are not in a community state ,minnesota thank you

She shouldn't be, but to be on the safe side, go to
http://www.annualcreditreport.com
and check your Credit Report. See if any of your CC's show as Joint and her name, or her name shows as Authorized User on any of the accts.
Hubby and I have been married so long that even tho I'm the primary the acct shows as Joint, and visa versa. Our credit is very intertwined.
If your wife isn't on any of the accts, you can simply file BK by yourself and not affect her. At the start, her income will be added in on the Means Test, but then it will be subtracted back out later.
If her name does appear on any accts, you can see about having her removed from the accts prior to filing.Filed Ch 7 - 09/06
