    New to forum...need advice

    I have a question for you guys. My wife put her two weeks notice in at her job for personal reasons. We currently pay about $800/month on credit card minimum payments. If another opportunity doesn't present itself for income to replace the lost income could we still file bankruptcy even though she quit her job rather than lost it?

      Just a note here,
      Yes you can still file for bankruptcy even though she quit her job for personal reasons.

      Only problem is if she quits her job, file BK immediately, then the Trustee may look at this as a way to cut your income for bankruptcy purposes......

      Income helps determine whether you can file Chapter 7 or put into a Chapter 13......

      If months pass before she can find another job, then you will basically be safe regarding the income issue if you file BK...

      Really, the longer she is unemployed before filing BK the better it is regarding the income issues.....

        Advice can we file?

        Well thie is all embarassing but here goes.

        We are in debt about 34,000. I make 65,000. here are a few details.
        Practically all our debt is cc. With a little medical thrown in on the side. The medical bill is in collection.
        We dont own a house as no one would finance us and homes are really really expensive here. We have only one car a 97 dodge caravan that we had to have repairs done to...and we had to skip a months payments to conver the bill.
        My wife works on the week ends. She cant go full time because 1) we cant afford another car and 2) child care would eat us alive. We are a family of 7.
        17,15,9,3 yrs and the youngest 5 months. My two oldest are going to a religous school they have to go..please dont flame me for that..the next oldest is being homeschooled..we really dont like that option but its the only one we have.

        Do you think we could declare bkruptcy?

          7 of you! Wow....how do you do it? I wouldnt begin to get on your case about sending your children to a private religious school because that is exactly where we send our youngest son. And we have some very good reasons as well. I will tell you this however, it was a semi-bone of contention for the trustee. From her viewpoint it looked like we were spending money we didnt have to but like you, we were able to explain our extenuating circumstances to her. I wont bore you with our tales of woe suffice to say we had some catastrophic medical issues and credit card debt but mostly medical bills...astronomical ones. Anyway, I would consult an attorney and see what your options are. Consults are free. As for your wife quitting her job...I was only working part-time when we filed. It wasnt that I didnt have a full time job but my hours and pay were cut without any kind of warning. Even after that happened we still had not contemplated BK; it was 6 months later before the bottom fell out. The 2 supposed bones of contention for the trustee were my son's education and my job...the trustee never brought up the job issue and we were able to justify my son's tuition. I dont know if they require it now but when we were summoned to meet with the U.S. Trustee we had to give her(in writing) an explantion why we filed and the all the circumstances that caused our filing so it can be done and you can do it....good luck!
