Where can I find the Homestead declaration forms at? I have looked everywhere and cant find any. I know these have to be filed with the courthouse before filing but just cant find them.
I'm sure it's different from one state to another. Here in OK, it's filed with the County Tax Assessor's office @ the county courthouse - it's free, here.
$5000 plus $500 per dependent; may also claim rents & profits; sale proceeds exempt to $5000 (husband and wife may double), Cheeseman v. Nachman, 656 F. 2d 60 (4th Cir. 1981); unused portion of homestead may be applied to any personal property
Not sure if this is of value to anyone, but I spoke to an attorney about the possibility of filing a homesteading on a piece of land that I own in another county. He said that unless I have concrete plans to build on the land in the immediate future, you can't "homestead" land alone, only someplace with property and that you are living on.
I was hoping to protect my little piece of land in my upcoming bankruptcy, but it doesn't sound like homesteading will do it. Just FYI, in case anyone was wondering about filing for land versus a home (as I was).
