    Dreaded calls

    Hello Forum:
    In your experience. How long does it take for your lawyer to get the process going. In other words how long did it take to file your petition and cut down on the dreaded phone calls.

    Have you already retained an attorney? If you have the next time a creditor calls, tell them you're filing Chp7 and give them your attorney's name and number. Typically notification will be recieved by creditors 7 - 14 days after your petition has been submitted to your federal court. You can expedite this process yourself, by faxing or over night mailing each creditors a copy of the "stamped" page of your petition, and your creditors/debt schedule too.

      If you're using a lawyer, once you complete the paperwork at his office, ask him how long it will take to get to the court house and do your official filing. Once that is done, you will have an offical BK petition number and once given that, creditors cannot harass you anymore.

      If you file yourself, obviously you will be responsible for notifying your own creditors and giving them the petition number.

      Once you file it typically takes about another week before all creditors have been notified of it and then the phone calls stop. However, you can at any time tell any creditor who calls that you have filed or are filing and who your attorney is. Most will give it up by that point even if they haven't gotten notification of the petition number.
