Repo time table

Is there any paperwork that needs to be filed or anything else before a repo or can they just come and take vehicle any time they like after you miss a payment? - jb

If they have already hounded/threatened you - you must have missed more than ONE payment - they can come at ANY time.

Magyar, if you file before they repo, does this change anything?

By filing before the repo it will buy you some time maybe 1-2 months before they ask the court to remove the automatic stay so they can come and get it.

We stopped paying in Aug. filed in Sept, my case is still opened. They never filed the paper work to lift the stay and came and repoed the item anyway. They took it 3 months after we filed. They never even called or sent a letter.

they don't have to file any paper work unless you have already filed. and Jessiegirl didn't they come take your boat even after you file?

repo even if making payments?

I have kept up with my car payments after I renegotiated the payments to $110 from $368 to a credit union where I also owe $7,000 on a Visa cc...
can they really just come and get the car even after I file ch7 bk?

Also, can the CU refuse car payments once I file bk? I think I read that in another thread.
