We bought our vehicles on Dec. 28, 2009 and are filing Wednesday March 10th. We originally planned to keep the vehicles, but my mother moved in and our monthly expenses increased a LOT as we are supporting her 100%. So, we then decided to only surrender one and not reaffirm the other after the 341 meeting. Today we were told that since both vehicles are financed through AHFC, we need to go ahead and plan to surrender both - no problem. We pass the means test even if we say we're surrendering them. BUT - won't it be a problem to file since we purchased them within the 90 day grace period? We haven't used the cc's in the 90 days. The paralegal wasn't 100% sure. She said we would discuss it with the attorney on Wednesday, but I am a ball of nerves right now. I'm still having a difficult time understanding how in the world we pass the means test without both car payments! Without one I understand b/c it is being replaced by my mom's medical stuff, but not the other, which is $500/month.
