My injuries were from the repo company. I called the cops. The cops arrived and helped the repo company, when I tried to get my wallet out of the truck I was arrested. Police refused me medical attention and took me to police station. Cop told me to leave the station and that I could use the payphone around the other side of the building, which was in turn locked as it was 2:00 am. Knocked on the police door and just got ignored. I ended up walking home with no shoes, in two foot of snow, and a broken leg and completely detached ACL. Repo company has no insurance, so I will probably get very little to no compensation, repaid for two years of lost work, no medical bills paid, etc.

Very good advice. Additionally, some garage door opener buttons, located inside the garage, have a "kill" switch which will prevent the remotes from opening the door. I know that not all have this feature, but the last home I had built did, and I used it when I went away on extended trips. Nothing like coming home and your garage door is wide open! I'm really glad justice is working in jt's mom's case, too.
Unfortunately, in many cases knowing your rights and trying to defend them just ends you up against an immovable wall. (Like the police refusing to take a report, or worse - - victimizing you. Or no attorney will take your case because they think your case is too small dollar to bother with.)
This is turning out to be a heartening story. I'm just sorry poor jt's mom had to go through all of that in the first place.
I'm guessing the repo guy must have posted bond to be out of jail so he can be making those phone calls and still causing trouble like that. I hope he ends up doing some really hard time for what he did to that poor woman.

I am very very excited to read that law enforcement and civil attorneys are doing the right thing. I'm sure the civil attorney's took the case because the bank itself is liable for the action of "their agent"! I am real glad that you are getting some retribution. I wish I coulda got some in my situation. The police refused to do anything in my case. But I guess thats why there is a lawsuit against them pending right now. In my situation my leg was broken, ACL completely torn, and meniscus torn. The repo company dragged my mothers car off our property to get to my repo truck. They broke her transmission in her car. The police arrested me for trying to get my wallet out of my truck. But again thats why they are being sued. I had to walk home with no shoes in two foot of snow, about a mile with a broken leg from the police station. I havent worked in two years cause I needed surgery. Latest update is that my attorney says the repo company is not insured and cannot afford to pay settlment. They offered $20,000 and I will be messed up for life. My knee hurts every day, all day and I get peanuts because they didnt have insurance coverage. Really would of made me feel lots better if they would have been charged with a crime like you seem to be getting. Good for you man.

Mr. Repo sounds like he needs to go back to Repo 101 and maybe a class in having a little human decency.
He's calling your brother and sister in law jobs? They need to get in contact with the police about that see what can be done. Maybe add a little harassment charge to what he's already got.

A little update here...
Mr. Repo didn't provide proof of his identity (some weird state requirement) and therefore the vehicle wasn't properly repossessed. The bank has to now return the vehicle but it has already been sold at auction. The repo guy has also been calling both of my brother's employers and his wife's employer telling everyone that my brother doesn't pay his bills and is a worthless individual.
My mom is okay. She filed a police report and the repo guy has been arrested on 5 different charges (2 felonies, 3 misdemeanors). He has also been charged for charging a fee for recovery of personal belongings. Mom also visited 3 attorneys. All three accepted her case.
My brother is now in negotiations with the bank for the value of the vehicle and he is filing a deformation suit against the repo guy, again, an attorney already has taken the case.
Mr Repo told the police "he needed to make my mom understand that he was taking the vehicle by any means necessary and he's allowed to enter people's garages."

repo requesting payment for return of property
It is illegal for a repo company to charge a fee to recover property inside your vehicle. That property is yours and they have no right to whatsoever. Mail a certified letter requesting all your property that was inside the vehicle at the time of the repossession. List the materials and property that you know to be in their possession. You have 30 days to get it back or they can "dispose" of your belongings, which just means they keep it.

The repo guy has now charged a fee to recover the personal belongings that were left in the vehicle. I guess the idea of him returning the remotes to my moms place because he is one of the nice guys doesn't make a lot of sense, does it? If he had no intentions of entering the house with the garage remote, and he wanted to simply return personal belongings, then why didn't Mr. Repo return the child car seats and the kids' toys? Instead he charged $100 for A CAR SEAT!!!

Yes you are correct people do look at repo as lower form of life and police look at debtor as lower forms of life. These days police officers view themselves above everyone though dont they? Police these days are just weak minded individuals that want to repair their broken ego by making others feel lower than them. I want to make it clear that I completey respect any and all honorable police that follow the same laws they arrest others for. Everything is just one sided now.

critisize someones profession huh? They sneak in the night, trespass on private property, creep around peoples homes with children in them, harrass them on their own land, then sell the vehicles to their buddys under the table for less than half of the vehicles true market value. Am I wrong? Under the constitution that would be justifyable homicide. You threaten a man and his family on his property you get shot, so be it. That used to be the american way. You have the right to defend yourself. Now you go to prison for defending yourself. Its ok to committ crimes so long as someone owes you money or your big business and the cops agree usually?
Exactly what is their not to critisize. That isnt a profession, its a profession if shoplifting could be considered one. In this economy I would do anything to make a buck and support my family but not sell my soul to do so. I am laid off now from GM and run out of sub pay, on employment which is ending this month. I actually had the opportunity to be a repo agent and turned it town. In the end you still have to answer to god for your actions. They profit off the misery and destruction of others. Theirs an extra warm place in hell for those people. Can and should are entiirely two different things.
Remember we have courts? A bank can take you to court and have a judge order you to surrender the vehicle, if you resist its contempt, a crime. No anarchy or chaos involved, just simple judicial process. No feelings of anger or violation after the fact. Just sick that a person could not meet their responsibilities themselves, and have only themselves to blame.

This really isn't the place to be a critic of someone's profession. As with every profession, there are those that play by the rules and others that don't. The work that someone does for a living doesn't define who they are. It is not the repo or debt collectors that got us in the situation we are in. In this economy, some have to take whatever work they can find.
The information some of those who have worked in the professions we dislike so much can be helpful and provide an insight.
