    Student loans, harrassing collections, Q.

    Hey everyone,

    I know that student loans are not dischargeable with BK (I'm in the process of filling out the paperwork for a Ch 7), but last week DCS (collection company for my defaulted loan - $14,000) called my husband's estranged aunt who then called us and wanted to know what was going on. It was so embarrassing; however, I guess that's what I get.

    Anyway, I called them back and told them the # to contact me at and told them to never again call anyone else regarding this matter. Isn't it illegal for them to do that anyway? I told them that I absolutely cannot pay my loans in full right now but want to get on a payment plan. I know that there's a six month period after you file BK that's kind of like a grace period...

    Do I tell DCS that I'm filing BK and get the payment plan together (the lowest that they said they can do is $139 a month extended over 15 years) for AFTER the six months go by?? Is there any reason why I shouldn't tell them that I'm filing? I will be filing in about a month (making payments on it b/c I can't get the whole cost together to file right at this time).

    I'm so afraid that they're going to call other relatives.

    My brother got a ton of calls on mine, after I had my land line shut off. He told them I didn't live there, and didn't have a number to reach me, and they only called back once more, and he repeated it, and they never called him again. I don't have any other family, so it was the end for me, but it was definitely hard to explain to he and his wife, what was going on. But now, they are so helpful about everything, and have really come through, so it worked out for the best.
