    Need Advice asap

    Okay I have a minivan I paid 4100 for it it values on kelly blue book for 6600 I am in a bind still have not fully financially recovered from the house fire we had after the bk and need money I was going to sale my vehicle for about 4000 to pay of the money I owe and turn around and buy another van I found one for2900 well this girl test drove my van and said I only have 3000 I said no way she said 3250 I sceptically agreed she said I will have the money wed I said okay well after praying and thinking about it I cant do it for that much. I called her and told her that she said I already borrowed the money from the bank. Well the thing is she said it was going to be a secured loan the bank did not even call me. anyway she said they will charge me if i cancel the loan. She said she was only borrowing 3000 and came out of pocket 250 but I think she borrowed more than that and already spent some of the money but it isnt my fault right? my questions are
    1. will they charge her a fee to cancel the loan?

    2. If it is not secured she can buy something else right.

    3.If it was secured they would have wrote the check to me right

    4.Should I just go ahead and sale because I said I would?

    5. am I liable for any damages if I dont sale can she sue me? I did not sign anything but I did say I will sale for that amount but I changed my mind.

    I am trying to just keep my faith and trust we will be fine and not sale. If I do sale it cant be for that low. I just dont do good negotiating under preassure.
    Sometimes life make you deal with ugly and hateful people ,just think of them as sand paper. They may scratch you and rub you the wrong way but eventually you end up smooth and polished and the sand paper becomes old and worn out.

    1: did she really take a loan? most loans have no pre payback penalties. I doubt any bank would just write her a blank check for a vehicle without requesting appraise, or a lot of paper trails that result in bank loans. its possible she is using a check from her cc company to draw funds from.

    2: who cares what she does with the money, if she in deed has it., thats her problem, if she wants to pay the bank back or go out on the town, its her business.

    3: she could have gotten a personal line of credit, the money would be given to her to do with what she wants.

    4,5 You did not have an actual written contract, I would not worry about it, what is she going to sue you for, changing your mind? I would not worry about it, and for what damges? what was damaged? if she did get the loan from the bank, she can hang on to it for another car, or give it back to the bank, thats her personal decision she has to deal with.

    put a small ad in the paper, and sell it for what you want.

    buying the same old computer that i currently had, couple days later, I told
    him that i changed my mind, he threw a pissy fit and told me he had just ran
    out and bought $1000 worth of this and that, bla, bla, bla... what im saying is,
    who knows what truth she is even saying....

        AGREED,
        Just simply let her know that you changed your mind after thinking about it overnite.

        If the loan was obtained thru a bank or credit union they would want title, etc.

        Nothing in writing, no money has changed hands.....

          Don't let this woman bully you. She is SOL without a contract. It amazes me how people become bullys when they don't get what they want. You changed your mind. That's life.

            Sucks for that dude. That's why you don't go out spending money you DON'T have yet!

            Adults are allowed to change their minds. There was no written contract so there is no obligation. This is why it is important to get things in writing.

            Years and years ago, back when I was in college, I found this car I wanted to buy but I didn't have the money yet. I was going to use some of my student loan money for it. I knew when I'd get the check (it was a couple of weeks) and the lady was anxious to sell it. I made a deal with her. I gave her an extra $100 (above what our agreed to price on the car) if she could "hold" on to the car for me for 2 weeks until I got my student loan money. The deal was that if I didn't have the money for the car by a certain date she could keep that hundred bucks and then sell the car.

            We got all of this in writing, mind you.

            What ended up happening was I received my check, as expected, and I went to her house and gave her a check for the car. She actually told me she didn't think I really had the money and so she'd get to keep the $100. I reminded her she STILL GOT to keep the $100 (it was extra from the cost of the car itself) AND still sold the car! She laughed and realized I was right about that. :P Ultimately, I didn't pay her full asking price for the car, though. We did negotiate on that. All in all I got a very good car for a very good deal, and she sold a car that she was anxious to get rid of for more than what she thought she could get for it.

              How is the bank gonna charge you?? You're not their client. That chicka is their client. If anyone is gonna incur a cancellation fee, it's her.

              It's your van. You don't have a written Sales Contract. Depending on your State Laws regarding Verbal Contracts, you may be pretty safe in not selling if you don't want to.
