    When There is no Legal Recourse.....

    I posted last week about my husband's uncle's lawyer receiving the deceased uncle's inheritance.

    We received a copy of the will today and sure enough - the old man's entire inheritance is going to the lawyer. It can't even be put through probate because the old man put the lawyers name on all the account 2 yrs ago. It's a conflict of interest and this is a predatory lawyer.

    I feel bad for my mother in law who did alot for her brother. Yet, her own brother bad-mouthed her in the will. What an ass.

    Legally, it is not worth our time. We know the lawyer has crossed all his t's and dotted all his i's. We will probably write a complaint against this lawyer to the Bar. This will be public record.

    BUT - we can also tell this story. I've contacted the local newspaper. This is a story that readers will be interested in. The old man is dead but we can at least embarress the hell out of this crooked lawyer in his own community!

    I'd check state laws because it may be possible to have the will decared invalid because of undue influence of the beneficiary of the will,

      the lawyer drafted and typed the will but we have no way to prove it. and the lawyer is not named as the executor of the will, although he is executing it.

      If he had been named executor in the will then there would be an obvious conflict - something tangible to fight in court.

      The whole thing smells like a bad fish but the lawyer made sure we had nothing tangible to fight back with.
