    So I Called B of A Today

    I have let very few of my creditors know about my BK as of yet but am getting tired of all the voicemails so decided to start calling them back slowly. I called B of A today and the guy asked me the amount that I was BKing on. I told him that he would have to direct that question to my attorney and he said "Oh, you know the drill, huh? You've done this before". I said..."ummmm, no." He said "OH".

    Now B of A has actually been pretty nice even though I haven't paid them in seven months but I thought that was pretty rude. Not anything to get upset over, just funny.

    One of the lawyers I spoke to said they are the more leniant of the creditors.

    I've been waiting and waiting because I have the most debt with them. Probably for naught and I should go ahead and pull the plug.

      I specifically told my lawyer that I was worried about B of A because I owe them 34K....probably more now...much more than anyone else. He said that B of A is actually pretty docile once they find out about a BK. I asked him "even when the amount is so large?" and he said yes. We'll see.

      I didn't start telling anybody until a couple weeks after retaining my attorney. But I figure now that I am in the home stretch of paying it off, might as well stop the noise.

        I had a credit card with BOA for approx $7k; they never filed a claim.

          We would all do well to remember that banks are theoretical entities that have absolutely no feelings. While defaulting on unsecured loans and credit cards is not in the best interests of the banking entity, the sheer enormity of the entity means that it's existence is not threatened by debtors going into bankruptcy. As a policy they will do all that is possible to prevent or discourage it, but the only one who cares is the debtor. The bank's human representatives deserve to be treated with respect, even if they get a little bit too enthusiastic about their jobs.

            Well that's good to know about BofA. I'm like 10k in the hole with them.

              Out of all of my creditors (8 of them), Bank of America has been the nicest by far. If all of my creditors were as kind as Bank of America was, I wouldn't even be BK. We have an $8500 balance with them; they offered to settle for $1350. Of course, its too late for that and my other creditors haven't offered anything good. Chase is by far the worst. They sued me on one account after 90 days delinquent. Then I found out that they bought one of our accounts from another credit card company. We gave them our lawyers name and told them we had retained a lawyer to file for bankruptcy. Two weeks later, they sued us on the other account.

              I never heard a peep out of American Express either. Citibank has been very aggressive, but hasn't called back since I gave them our lawyers name and number.

                That's good to know. My checking account is with them and I have a -6k car loan plus -5k on a BoA Visa.
