    not elligible for 7, must go to 13 & convert to 7

    sorry for the confusing name of the thread...

    my income and equity in my home does not allow me to file 7.
    However my income will not cover the payments for chapter 13.
    Thus I will have to go through the "backdoor" and file chapter 13 and then it will convert to a 7

    ANYONE ELSE HAVE A SIMILAR SITUATION?

    I think you might be better off deleting this post here, and trying it in the Ch. 13 OR Ch. 7 forum. (Delete it here because you're not supposed to have the same thread in 2 different forums.)

      that is exactly what happened to my grandmother though I dont think they actually planned it that way because she started out not eligible for ch7 based on a different law than what you are looking at, yet went from a 13 to 7 just like you are saying and for the same basic reasons.

      this law does have some very twisty turny funny things about it that people never expect to happen & are not aware it can happen.

        Our attorney suggested filing a 13 and then dismissing and later filing a 7, because we paid down a little equity in our home within 1 year.

        How is that different from "converting" to a chapter 7?

        Does anyone know the major differences - pros and cons of each strategy?
