thats funny, why on earth did they list yours as a no asset. obviously an error.
maybe they are thinking they made a mistake and gonna give it back so they dont get a bite chewn out of their ass when you sue them lol

When I filed, it was filed as a NO ASSET case, and they just never changed it..... when it became an "asset case".. So according to the law - I filed a no asset case!!
Hope yours is almost thru for you.....

Mine still says "no Asset case" - DUH - and they took my home and sold it......

Ok, this might be a dumb question but my case was listed as a 'no asset' and the BK has been discharged and closed but the home hasn't been foreclosed on yet.
The mortgage company has filed to restart the foreclosure so will my case be re-opened or just the home sold? (The amount we declared for the home will more than make up for the difference between sale price and what we owe.)
umm, im unfamiliar with homes sales stuff so i also have questions.
why wasnt his case listed as asset?
why was is closed already if they have a home to sell?
doesnt the trustee own tthe home and sell it himself?
when its sold do they get any of the money they claimed on it as exempt?
does that money come before or after they pay off other creditors? or does it come right off the top first, then divied up?

Let me say that again. It won't be 'well more' than what we owe but it will cover the deficiency balance. We had someone come in and tell us what the property would sell for and then we factored in what we owed, so we listed the combined amount.
There won't be a 'surplus' after the sale which is probably a 'no asset'.
In our case it was listed as "no asset" and also "abandonment of interest in auto's, etc...". Then came the objections to "Trustees abondonment report of no asset" (I forgrt the exact term) by the Trustee and the and he also came after the autos. 95% of all cases are no asset so it is normal for them to file a preliminary report before he examines everything. In all likelihood you will be no asset but it could turn around, don't panic if it does. The problem with BK is that it can, as happened to us, be ok one minute and bite you in the a*s the next. I'm really waiting for that next milestone which is approaching, 2 years from discharge and then 2 years from closing, already done the two years from filing deal.
Hopefully you plowing towards discharge and you can get your house back in order.
Until then you must view the Trustee as a violent dog ready to plunder your family and if you face his lawyer, argue in a nice, even, truthful tone but in your mind ready to pounce on him like a ravenous rabid wolf ready for the kill. Don't fear him.

Are you talking about my case? I just thought that since the foreclosure was filed pre Ch. 7 that the foreclosure case can recommence once the bankruptcy case is complete and that's what the mortgage company is doing so they can legally get their property back.
