    Hello all

    while I research this I was wondering if I could throw this out there as it legal issue - grant it's a divorce/parenting question:

    My ex just texted me saying he can't afford daycare any more so he wouldn't send the girls there on his parenting days. But our divorce judgement has the following entry under Child Care: Beginning when the minor children return to school in September, 2009 the parties shall equally share the cost of any child care costs 50/50, pending further order of the Court.

    I am reading that as we must pay any daycare cost 50/50 regardless if they are there on our respected parenting days. So if thought he chooses to not to send them to the daycare center he still has to pay 50% of any daycare costs.

    Timing is losy as I am sure my divorce lawyer is gone for the holiday weekend but I am going to call him anyway - I just want to bounce this off some folks to see if what I am reading is correct.

    Happy New Year to me

    My divorce Lawyer called me back - I was 100% correct he would still have to pay for daycare regardless if he remove them during his parenting days or not. Yeah and my lawyer stated that if he refuses to pay I can file a motion to have his tax child credit removed and give back to me. Small victories. Not only that he would have to pay all my lawyer fees if I won. Oh happy day to me.
