Well, 341 meeting tomorrow (Tuesday)...

Hopeing for the best, and trying to avoid thinking about the worse. ;) Needless to say I'm more than a little nerve-wracked over this. Been over the "341 Questions" threads about a dozen times, so we'll see.

Got throw a curve today: went by to do a last-minute check with my attorney to make sure everything was still on track, and guess what? Turns out he won't be the my 341 tomorrow because he's out of town! No notice 'er nothin! :blink: What's up with that? I'm familiar with the lady that'll be there in his place, but I just think it's rather poor style to not even tell your client that you'll be out of town for his 341! Dunno what to think about this, but I think it's too late now.

Wish me luck, folks... I'll post tomorrow evening with how it all goes!

Good luck GoingUnder. I will be thinking of you. I think it's fairly common practice actually that another lawyer represents you at the 341. At our 341 there were a couple of people who had another attorney than the one they "hired". Anyways, again, best of luck, hang in there and let us know how it goes.

I already know mine will be that way, but we're going to have a 3 way call with the "new" lawyer so I don't just meet him new the day of the 341.

Well, thanks to everyone for your support! :) Had my 341, and it went pretty quickly: no creditors showed up (as many have said here on this board), but a couple quick hiccups occurred; maybe you guys can let me know if there are any "real" ramifications to those...

First, I have a small plot of land that the county assessor says is worth about $500. Trustee asked me how I came to that value, I told him it came from the assessors website, and he promptly suggested that that was probably a bad estimate. For valuation of assets, he suggested that we TRIPLE the value of the land. I think he mentioned that it really didn't matter since the value was below the (muffled sound) threshold ;) so I'm not sure what the effect of doing that is. Thoughts?

Second, my attorney suggested I leave off two credit cards (BofA & Shell) because the balances were so low (about $150 each; I plan to pay them off before the confirmation hearing). In listening to the cases before mine, the Trustee asked if all creditors were listed. Suddenly, I'm panicked. I turned to my sit-in attorney, told her the schpeil, and she says, "Well, I'd NEVER tell you to leave something off, so you better talk to your attorney." Blank look on my face: "You ARE my attorney today! What's up?" So I tell this to the Trustee, the attorney gives him a little more backstory, and he kinda sorta ignores it. So now I'm starting to freak out! :blink: Is my filing right or wrong? Should I bother or not? Two attorneys with two different ideas on the subject, and the trustee not saying a word! What the heck, man!!????

Oh, and InLimbo: Good luck tomorrow! My best advice now that mine is over with: "Don't over-think the thing!" :D

Your fine, don't worry about it. Perhaps your main attorney figured you would have paid them off before your filed because the balances were so small. It really doesn't matter, when it comes to small balances, less than $200...no one is going to care if you left them off your petition (so long as there are not too many of them).

Oh, and on another point, it looks like the trustee IS going to ask for more money. I saw their paperwork and it looks like they're going to set it for $462/month, instead of the current $400/month. I think that's gonna be pretty tight, but I'm going to go home tonight and do some math to see where I'll be sitting. Not a huge difference, no, but still will make things tight if it goes ahead.

Going, Im glad your 341 is done and over with :yes2: It sounds like it went fairly good and I'm happy for you! I will try my best not to "over think" things, but I'm telling ya, I'm a basket case already:( We will be lucky to slip by with a chapter 7 so I have tons of worries about what questions are gonna be thrown our way. I agree that it's kinda crappy of your attny not to tell you about his/her absence and the stand-in coming.

Sounds like, overall, everything went well for you tho. And your original/regular attny did a good job of getting close on the payment.

I know amongst us BK folks not to say, "It's only $60/mo." :D Might as well say $600!! :cool:

Glad that your 341 is behind you, GUINV! Had a bit of a tougher time with the different lawyer but you got through that too. Hope your payment lands at a level you can survive for the long haul - hang in there and know we are all here rooting for you!
