Question about plan base

    Question about plan base

    I am assuming the plan base is how much you will be paying out over the course of the bk. My question is that my bk is 60 month and my plan base is 10800 and my monthly payment is $300.00, so that comes to 36 months, right? So why would my lawyer tell me I am on a 60 month plan when the math isn't coming out to that, unless I am missing something?

    I don't know if you have filed or if you are just researching filing. The attorney should have given you a written breakdown as to figures as to your Plan or if you have filed a complete breakdown of your plan for Trustee approval. A Trustee's fee is also included in your Plan total. The breakdown would show you exactly what is included in your Plan payment and the percentages involved.

      Yes, I have already filed and been confirmed. I was just nosing around on the data center and doing some math and it didn't compute.

        13DataCenter and the other Ch 13 trustee websites are not consistently updated and also can have data entry errors. The official papers the court sends you are the best source of truth about your Ch 13 case.

          Ok, so I found out that everyone will be getting a total of $18000, and with my payment of 300 that wil take the 5 years. So I guess I am confused about what the plan base of 10,800 means?

            Sometimes when your Ch 13 is on the newer side, the amounts that show up as owed include only your secured assets that the trustee is disbursing to at first. (The trustee pays off your creditors in a specific order set by the current bk law - trustee admin fee, your lawyer, and your secureds first, then preferred debts like the IRS, and last your unsecureds. Once payments start to your unsecured creditors, that amount will be added to the total. It all depends on your trustee office's ways of utilizing their 13Network website data.

            Have you asked your lawyer about the discrepancy? What does he/she say?
