Just saw last payment cleared the bank

I just saw my last payment cleared my checking account. I didn't even have to pay the full amount this month. I called the trustee's office and asked whether I need to send the full payment or what was left showing. She told me to send in what was left showing and that after the audit, if I owed anything else that they would let me know and that I could stop sending in payments. Yeah, an extra $557 a month, just in time for my son leaving for college in three weeks.:clapping:

My last payment cleared the bank last week! Do you get a letter from the trustee saying the audit is completed and your case has been submitted to court for discharge?
I am so anxious to get my house refinanced. I owe my attorney extra money which was going to be paid outside the plan with a refi. Not sure if I should try for a refi when I get a letter or wait a few months for credit scores to go up. Will the discharge make a noticeable difference in the credit scores?

Here's what usually goes down after you make your last payment. You should receive a letter from your Trustee indicating they received your last payment and the course of events that will take place for you to be granted your discharge. The Trustee will send out any remaining payments to creditors and also send to all creditors documentation for them to sign and return to the Trustee. When all that signed information is received by the Trustee and your Plan audited by the Trustee, if it all jives and is in order you will receive your discharge. Here is our timeline for those occurrences.

Paid off Plan - 4/11/06
Trustee Letter Received - Early June 2006
Discharge dated 8/30/06 received early September 2006

As to refinancing - I would not do so until you receive your discharge but, in any event, consult with your attorney to see if it is possible to start investigating options during the predischarge period.

All the audit is, they look back over the length of your bk and make sure everyone who filed a claim received what they were supposed to, no one got overpaid or underpaid, and that everything else is generally in order. I made my last payment on Sept 1st, and was d/c'd about a month later.
I see no reason why your wife can't be looking for a more rewarding job.
I would wait to sell the boat or truck until I was officially discharged, just to make sure no waves get started, after all, you should only be a matter of a month or so away from being there.

Sheesh, are we ever ready to get this nightmare behind us. 16 days left before we make our LAST MONTHLY PAYMENT!! It's nice to hear that your official discharge came shortly after your last payment. But, for us, our paperwork says discharge will come after 6-8 months. :(
The worst part of all this is our "so-called attorney". If you ever ask him any question, he always replies with, "well, what do you think" in a very smart-ass, arrogant tone, and then says he'll get back with you which he never does. So, I have to go to forums like this to ask others about their experiences and their advice to hopefully get an answer to my questions, all the while realizing that it isn't the legal advice that I paid that clown for. What a shame!

Well, I made my last payment last month, but they didn't send out the whole amount to everyone, so they will make one last payment this month of $187 which is still in trustee's bank that is owed, so I will then be on my way to discharge. Why oh why didn't they just send it all out last month!!! Oh well, at least I don't have to make a payment this month.

Well, not to get your hopes up, but are you sure you still owe anything? My last month that the trustee disbursed, they only took 12 cents out of my last payment( paid every two weeks, so each month's disbursement was at least 2 of the payments) I eventually got that money back, plus 2 or 3 other payments that got deducted before we got the stop deduction order to my payroll dept. So you could get lucky enough to get it back, maybe.
Has your trustee ever left that much sitting since they started disbursements? The most mine had left before was just one cent. For some reason, every few months they would hold a penny until the next month, but most of the time my balance was zero on the second of the month.

Here is hoping, but don't get your hopes up too much

I kept up with mine on my trustee's website, and also at 13datacenter.com (http://13datacenter.com) . Your trustee must participate in 13datacenter in order for you to be able to view your balances. Even now, a year later I can still log onto both sites and see all my information, including that wonderful case closed and discharged.

I hate to burst everyone's bubble in this thread but just because you have made or are about to make your last payment do not think you are done and that this is behind you. It depends on where you live and who your trustee is. We made our last payment Dec 17th 2007. There was nothing extraordinary about our 36 month chapter 13 plan. Also like many of you we read these forums and assumed we would be done by say March. Well guess what it is now September and we still have not received our discharge. In fact it was not until Friday that the Judge finally signed the paper certifying our trustee's final report and accounting. It is a 30 day process just for that to happen. That is here in Western PA. First the trustee files the final report and accounting(the result of the audit) and then it is mailed out to your mailing list of claims. They are given 30 days to respond. Which usually means you wait 30 days for nothing. So now after 8 months of waiting we are hoping that the court/judge will be signing our discharge and post it on pacer soon. Well just to some it up it aint over until it is over. The best way to watch it is on Pacer you will see it there first.

My last payment to the trustee cleared my bank on 9/02/08. I received a letter today, 9/11/08, from the trustee saying "congratulations", etc. Enclosed was a copy of a simple "Plan Completion Report" and info regarding documents to keep and future credit reports.
Then today, I got an email from my attorney's office saying my discharge was signed by the judge today, 9/11/08. She attached a copy of this discharge.
She said the courts file and their file will be closed very soon.

I was not expecting this to move so fast but am so glad!

My trustee always had $600Plus hanging in my account after every monthly distribution. I don't know why that is, but there was always a chunk of change left over every month. They just doled out my $557 a month to creditors and not a penny over that. That is why the last month I only had to send in a partial payment and not the whole 557 and I thought that they would just disperse it all, but no, only 557 and that is why they still have $183 in my account and $183 is what is exactly owed to the creditors. She said that dispersment would be made around the 20th of the month. It does say about to close on my status.

Plus, I made sure that I put a on the note line of the check "payoff approved by ****." Just wanted to cover all my bases.

I just got my discharge paper today...discharged as of 9/8/08.
I want to cry...with happiness and relief. Is it REALLY over?
I am totally free of the BK court? :unsure:
