    Question Surrendering Vehicle, how is the title handled?

    I'm expect to surrender a couple of vehicles and my situation is kind of weird. I was hoping to understand how it "normally" works.

    Generally, all states have a lein-holder shown on the title. However, some states have the lein-holder keep the title while others have the owner keep the title.

    When you surrender a vehicle in a state where the owner holds the title, what happens with it? Say they tow the vehicle away at 3:30 AM. Do they apply for a duplicate title or do they knock on the door and ask for the keys and title -- pretty please?

    I have a vehicle financed in another state where the title holder situation is opposite of where I live and this has previously caused some confusion. I'm expecting to have a vehicle or two towed away soon and I'm wondering what I should expect.
    Discharged November 2008 100 days after filing no-asset Chapter 7. We intended to let a two-year-old vehicle go back to the bank and reaffirm an inexpensive ten-year-old SUV and our home mortgage. In the end we surrendered ALL of our vehicles and reaffirmed NOTHING. We'll "ride through" our mortgage after the court ruled it an undue hardship.

    Usually the lender holds the title until the lien is paid off on the vehicle and the lender sends the satisfied title to the purchaser. In that situation, there is no problem - the lender has the original title and handles it upon repossession. However, in your situation as to one vehicle with you having the title in your possession and there being a lien on the vehicle, there might be verbiage on the title itself as to what to do (look on the back), pull our your contract when you purchased the vehicle to see how that is handled if there is nonpayment and the vehicle is repossessed (there may be verbiage in there as to that situation) or contact your Motor Vehicle Division to see how that is handled as to the vehicle title. Your motor vehicle division should have a link on your state website and may have that information online.

      The credit union sent the tow guy Monday to get our vehicle. We had not even received notice from the court yet when he showed up. (got it the next day) BUT he took the car with no title. We are one of those states where we have the title and the lein holder is listed. He never even asked for it.
