Is Monday for me. I'm so scared. I have a Lawyer.....I'm doing a 7.....he seems to think it's no big deal. I'm so afraid everyone. Scared of what they will ask and what the tt will want afterward and if I will ever even get a discharge. I don't know what to think??? What are some things they will ask.... I'm so nervous.....please help me???

You are going to be fine...you need to relax a little. After the 341 next week, you are going to wonder what you stressed about all this time? If your attorney has no problem with your case, I'm sure there is nothing to worry about.

Just relax.

He'll ask some basic questions about whether you read the petition, do you understand the petition, did you sign the petition.

If there are assets being surrendered he may ask about them.

If there are any non exempt assets he will ask about them.

denise, i thought the same thing: why on earth is my lawyer SO calm? can't everything go wrong? won't they eat me up alive? how could my lawyer be so relaxed, for heaven's sake??? how can he possibly be saying that my bk "will" be successful? he can't promise me that, can he? everything will go wrong, right?

well, the answer is that he has done this forever, he knows my case, and he knows there is no reason to worry. so far everything he said was right on the money (so to speak...).

so my suggestion is to try to trust your attorney. choose something you particularly like doing, and do it over this weekend to keep your mind off the 341.

You will be fine. They really only ask just a few questions and then they may have sent you a sheet of questions that you answer yes or no to and sign and turn in to the trustee.

It goes really quickly! You'll be out of it and done in no time!

We have our 341 Monday too. 11AM. I am not too awfully nervous, mostly cause I have read so much about 341 on this forum. It will be fine, if your attorney isn't worried, you will be fine. You attorney will be right beside you.

I have pacer and check it everyday. We have no creditors even coming to ours so far. I have checked! LOL It's simple to set up an acct and I like it mostly cause i can watch what's going on. It might ease your mind a little if you set up a pacer acct. The cost isn't bad, just don't go crazy looking at other's cases like I have! Our date of discharge is also the same, that makes 3 so far on here who have the same 341 date and same discharge date.

sept 18th would be the last day for objections. discharge date could be any time sept 19 or later.

forget about the 341 until monday even if it means somebody needs to hypnotize you to forget it. :)

How do you know you are going to even get a discharge??? I'm worried.....I woke up at 5:30 am with all these thought racing in my head. I'm sorry.....

If you keep track of your BK on pacer you'll know what's going on better. I watch ours that way, like so far, and ours is on Monday too, no creditor is send anything say they are attending our 341. So far ours looks ok. I am nervous too, but I am trying to not worry. We did everything they way we were suppose too, which I am sure your attorney did too. Try not to worry, it's going to be fine.

I think you should seriously get pacer, it's very simple to set up an acct. Just check and see what's going on right now. I bet all is fine.

We will be going the same day for our 341.

Far as discharge and close, the courts will send paperwork letting you know, but with pacer you can know before your papers come in the snail mail.

Seriously, at least you have a lawyer; I had to file pro se. I'm taking the mentality that I've done what I can do and I can't change what might happen. If they need more information from me, I'm prepared to give it to them. If they want to dismiss, I'll have to live with that too. We really can't control what happens, can we?

I've been checking my PACER account like justplaintired and the only thing that has been filed from a creditor was a Request for Notice/Service, which I have no idea what this means...do they just want copies of paperwork too or do they plan on attending the 341? It's a credit card, with a tiny balance, that I have not paid on or used in almost a year, so I have no idea what they are thinking.

i suppose i will have to give up on getting you to stop thinking about it. hey, i tried.

discharge of debts goes as far back as the old testament. it's not a new idea somebody came up with yesterday. it's also in the US constitution. the entire bk code, which is federal law, is centered around it. as long as you are not trying to scam the system or hide assets, which you are not, you will get your discharge.

I agree with Music12! You've got to relax Denise! The meeting really won't be bad and it will be over so quickly.

denise, Get Pacer! It will put your mind to rest a little. Seriously, I think that's part of the reason I am not worrying as much as you are, that and I spent more hours then I care to admit on this forum reading and learning.

Please be calm, don't worry, get some rest, enjoy your Sunday. Don't waste time worrying it won't change the outcome.

This is probably true, for me it's a huge relief. Watching what is going on. In Denise's case you're probably right. I think it helps me, after being on this forum for so long, I understand a little more about the process. I am confident in our attorney/paralegal, so I am nervous, but not as nervous.

Tinfoilhat...you are just to nice...you bring tears to my eyes. I didn't know that all of this would cause me so much stress. I feel so bad....I'm not a rich person.I'm living off alimony and a small retirement right now. I lost my job. I moved in with bf.I'm giving up the condo and car. All of this is scary for me cuz I don't understand it all.... It's like almost being in the dark. Thank you for the fudge!!!

You have a lawyer, Denise. If something related to your bk comes directly to you and you don't understand it, the first thing you do is call your lawyer. That's why you are paying him/her for legal representation during your Ch 7.

Well....I got throught it and it was easy compared to some. He didn't really ask me a whole lot.I had gotten one of those random aidits earlier and did it and sent it off earlier than the date needed. At the end he said... did you hear from the audit? I said no and he said he didn't either. He said.... I will have to keep the case open until I hear from them. WHAT DOES THAT MEAN????What do I do in the mean time.Will I know anything????? I don't have pacer. My lawyer could not talk at all cuz he had a lot of cases still that needed to be heard.I'm still so shook up....please help. I'm scared again!!! How do I keep up this waiting??? Suggestions????

maybe someone else who had an audit would know something about that. i'd suggest for you to start a new thread on this subject.

how to wait? i don't know. maybe think of it as being pregnant, just it won't take 9 months... and the result at the end will be a fresh start - but for you, not for a baby.

that's probably the weirdest suggestion ever made on this forum, but who knows, might work for you!
