    Filing a Complaint Against Creditors

    To file a complaint

    If you receive calls from debt collectors that you believe could violate the law, contact the Federal Trade Commission at 877-FTC-HELP or your Attorney
    General.

    06/28/06 - 341 Meeting
    07/18/06 - Confirmation Hearing - not confirmed, 3 objections
    10/05/06 - Hearing to resolve 2 trustee objections
    01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      This is what I've been saying for weeks... :-(
      My credit scores:
      Before Filing: Tr 496, Ex 496, Eq 507

      Today: Tr 618 (+122), Ex 601 (+105), Eq 623 (+116)

          I have been getting 2 -3 phone calls per day from a particular credit agency, NCO. The lady who keeps calling states that if I dont pay she will see me in court,(how does she know I am filing for bk?,lol) and then she says that if I dont talk to her she will just call when my husband gets home as she feels she will have better luck talking to him. I have asked her to stop calling but she still calls at least 2x's per day. Anything I can say to her to stop her?

            Send NCO a letter by certified mail return receipt requested (so they know you have proof of them receiving it) which states the following:

            "In accordance with the Fair Debt Collection Practices Act, I dispute the validity of this alleged debt and I request written verification of it.

            It is inconvenient for me to receive telephone calls from debt collectors at any time of the day or night and at any location. I demand that you cease and desist from any further communication with me by telephone.

            All future telephone calls will be recorded and may be used as evidence against you for your violations of the FDCPA."

            Keep a copy of the letter and the original certified mail receipts in case you need them later on.

            Most, but not all, third party debt collectors will stop calling you after they receive this letter from you. If they don't stop calling, they are breaking Federal and sometimes state laws. Then file a complaint against them with the FTC and your local state's attorney general.
            The world's simplest C & D Letter:
            "I demand that you cease and desist from any communication with me."
            Notice that I never actually mention or acknowledge the debt in my letter.

              This collector isn't going to stop calling you, CinVa. Just like when an obscene phone caller calls, when you hear that it's NCO just say nothing, quietly hang up the phone, and walk away. I've heard that some people do a variation on this - when it's the collector on the phone, they put the phone down and just let the collector talk nasty to the air, then come back in a minute and when the line is nice and quiet, hang it up. (I get a kick out of that approach myself!)
