    Amend taxes after bankuptcy

    Hi, lost my job in 2008 and i filed a chapter 7 in march 2009. They took my tax refund in 2009 and about $2,000 i had on hand to pay creditors. My mom has been living with me since 2007 and I didn't know I can claim her as a dependendt since she is not working and I provide all her living expenses. My case is closed and I got a discharge in june 2009 but if i amend my taxes to get a refund for the dependent i didn't claim, will the bankruptcy court take this refund? I went on turbo tax and I stand to get about $1,800 for each year. I could really use the money since I was out of work for about a year and a half. I did not have any federal taxes that i owed but will the irs also find out i filed bankruptcy and notify the bankruptcy if i don't notify the bankruptcy court?

    well...even if you did owe the trustee back taxes because they would have been considered an "asset"...that would only apply to one year.

    i suggest first call the atty who handled our case...i really think you should be ok...if anything were to become questionable it would only be that one year...and that is also only apply if you filed your bk at a certain time of the year...

    i.e. if you filed in the month of oct...be prepared to hand it over...however, if you filed you bk in march or april...you can keep it.
