    Will the trustee question my debt at the 341 meeting?

    My 341 meeting is on December 3rd. I am so scared and worried because of several payday loans I took out just weeks before filing. I didn't want to file on these but my attorney told me I was stupid not to file. One note here - I never intended to file Chapter 13. I got a summons that I was being sued and had 20 days to figure out what I was going to do......hence me filing Chapter 13 so quickly after incurring more debt. I fully intended to pay those loans off.

    My question - Will the trustee question my debt at the 341 meeting? My attorney said he will only ask me a few questions.....State your name, your address etc.

    I just cant rid myself of the pit I have in my stomach daily over this. I guess I just need some moral support in this. I feel so all alone.

    I was very nervous about my 341 but I was not questioned about my debt at all. My attorney told me that I would probably not be asked about it. However, he did tell me to just tell that truth if I was asked. The people that work in this field like the attorneys and trustees see this kind of thing all the time. His big issue was that the law allowed me to take the step of filing Chapter 13 to get my financial life back in order and that I needed to take advantage of that as well as follow the rules that place restrictions upon me while in the bankruptcy.

      Trustees have heard everything. If you are asked any questions, as the previous poster mentioned, just be open and honest. After going through all this most of us on here can truly say we never want to go through it again. Best of luck to you!

        Don't even worry about the payday loans. It's routine in these matters and no one but the payday company has seer got in trouble. (Especially when the payday loan company takes money from your checking account after you file.)

        At one 341 meeting I sat in on, I never heard any direct questioning about individual debts. It was mostly generic. Sure, a couple of creditor attorneys showed up too, but the one that I recall, only wanted to take pictures of a car.

          Nope, the trustee will not typically question you about a specific debt, but will probably ask you "Have you disclosed all of your debts?". There is an opportunity for your creditors to speak at the 341, but I haven't seen one speak yet. Good luck!
