the applicant if he ever filed for BK, would it be legal for the applicant to say "no"? I mean we all can get forgetful from time to time , and if it is not showing on one of the credit reports, then how would we know? I mean, even Einstein couldn't remember his phone number! it usually asks "within" 10 years have your filed. maybe now it's changed and the banks ask have you EVER, if that's the case, then i would say you couldn't or shouldn't lie. one would still think it could be found in a title search somewhere down there in the deep deep sea of where they hide old debts and filings.

No it would not be legal. Forgetting a phone number and forgetting that you filed BK is not the same thing.

Einstein did not forget his phone number. He chose not to memorize it because he did not see the value in remembering something that could easily be looked up, when there were things that mattered for his brain to concentrate on.

The number is irrelevant. He did not forget that he owned a phone.

Obviously, it would be on PACER. I guess that if it were were to come to the point in which the fact that someone misrepresented this fact, and there were some sort of lawsuit in which this fact were a material fact, then it would be up to the judge to make a determination about whether it is reasonable for someone to forget about a BK. I guess it would be the same as if someone were to forget that he had a child, etc., in which case the only way the judge would rule that it would not have been fraud would be if the person had some sort of condition that would cause him to be very forgetful.

Really, there should be a law that outlaws any question like this after that time frame.

From the way your recent posts are written it sounds like you are asking for advice on how to beat the system without actually posting that is what you are doing ;) No one just "forgets" they filed for bankruptcy unless they have great memory loss and then you have bigger issues to deal with than trying to get a mortgage.
