Any way to give BoA a push?

So we are almost 2 years out from ch. 7 discharge that included our rental property where we currently reside. While the free rent is nice we realize that the more time goes on that we won't ever be able to buy a single family until 3 years from the foreclosure. Problem is, BoA isn't doing anything! Seems like they may never foreclose. In the meantime, we are still upkeeping the property etc. Such a pain.

Anyone have any luck pushing BoA toward foreclosing? Or is a short sale possible? A deed in lieu? Anything?

I really need to move closer to work and we need more space.

There is not much you can do to force a foreclosure as far as I know. The only way to know if BoA will do a short sale or foreclosure is to call them and ask. You may not get a definitive answer about a short sale without there actually being a purchase agreement in place and escrow opened. If you decide to try a short sale, find a real estate agent who specializes in short sales. Be careful not to do anything that will obligate you to pay a deficiency or pay any of your own money to close a sale. Somebody else recently posted about a bank trying to get them to sign a promissory note for the deficiency amount in order to close a short sale.

$143,000 in debt discharged for $36,500, including attorneys fees. Money well spent!
