    Still confused on proceeding

    hello everyone,
I am about one year after my chapter 7 bankruptcy. I still have two creditors - best buy and mbna - who are showing charged off instead of iib. I have disputed these before but they won't change them. I know that MBNA merged with Bank of America around this time too. Anyway, should i dispute online, contact equifax, contact Best Buy and MBNA/Bank of America, or send in a copy of my bankruptcy papers to 1)BestBuy and MBNA or 2)Equifax,etc.
    Thanks for your help!!!!!!!

    Jeff.

Jeff, I moved your question into its own thread - you're likely to get more answers to your questions this way.
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

    06/01/06 - Filed Ch 13
    06/28/06 - 341 Meeting
    07/18/06 - Confirmation Hearing - not confirmed, 3 objections
10/05/06 - Hearing to resolve 2 trustee objections
01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
Countdown: 60 months paid, 0 months to go

Dispute the entries with the credit reporting agencies, i.e. equifax, first, and see what happens. Each CRA has fairly straightfoward online dispute features.

        They refuse to change this!

        Hi everyone,

I sure hope somebody on the forum can help me. I have disputed the charge off status on my file and this is the result -------

        New (after dispute)

        BENEFICIAL NATIONAL BANK
        03-2000
Bad Debt; placed for collection; skip $0 $0
        12-2006
Account transferred or sold , Charge off account , Charge , Trsf/Sold/Pd

        Previous (showing dispute in progress)

        BENEFICIAL NATIONAL BANK 0
        3-2000
Bad Debt; placed for collection; skip $0 N/A
        12-2006
Consumer disputes - reinvestigation in process , Trsf/Sold/Pd

There have been changes to the following account in your credit file. The change to your account has been highlighted below. If this information is incorrect, contact Bank of America MBNA.
Summary of Changes to Your Account

        New
        Bank of America MBNA
        12-2001
Bad Debt; placed for collection; skip $0
        01-2007
        Charge off account , Trsf/Sold

        Previous
        Bank of America MBNA
12-2001 Bad Debt; placed for collection; skip $0 N/A
        01-2007 Consumer disputes - reinvestigation in process , Trsf/Sold

Not all credit reporting agencies report data in the same manner therefore some fields will show N/A when the data item is not reported by a given agency.

Why don't they have information on my bankruptcy and how can I get them to change to IIB? Do I need to contact Beneficial and MBNA or send a copy of my chapter 7 to the reporting agencies? What would you do now?

        Many thanks!

        Jeff.

Dispute them as 'not coded correctly'. The coding is where it should state included in bankruptcy instead of a charge off.

            After disputing

            Filing on My Own,

Thanks for your response. I disputed them today like you said by calling Equifax where I have my credit watch service.

Now if it comes back and they won't change it, what would be the next step? Should I be mailing my discharge papers or contacting the banks directly? Must they report the IIB if they sold the loan?

            Thanks,

            Jeff.

PS Dell approved me for an account last night $2000 limit - my computer is telling me my hard drive crashing is imminent. Discharged - February 2006

That is a good question and I don't have a solid answer for you. The creditor has a good argument that since they sold the debt, they are no longer under any obligation to report any more information except that it was sold since the creditor sold their contractural obligations to a 3rd party, thus, if the 3rd party reports, they must report the debt is included in BK, but the orignal creditor may not have to.

You can try browsing this forum as they are more dedicated to credit report issues than our forum.

CreditBoards is another online discussion forum dedicated to credit issues that is more bankruptcy-friendly than MyFairCredit - http://creditboards.com/forums/index.php?showforum=34 . They have a pinned discussion on clearing up IIB accounts at http://creditboards.com/forums/index...howtopic=74980 - hopefully you can gain some insights there. Please come back and let us know if it's helpful.
