    Owing Taxes during a Ch 13?

    What happens if you end up owing taxes during a Ch 13? (you owe in April but cannot pay in full)
    Does it get included in the plan? be able to be paid on payment plan with IRS or put on hold until after BK?

    I can tell you my experience, first year doing taxes while in 13 i owed quite a bit, Lawyer had it added to plan and my payment went up a 100 or so, next year owed about half that and i have owed that amount for 3 years now and planed to pay it off upon exit of ch13, just got lucky with 2 payments left in plan trustee agreed to pay it off for me of course the IRS asked so that was a nice little surprise.

      One thing I think you will not be able to do in a 13 is a post-petition installment agreement with the IRS, a recent development. There is a thread on this from April 2015 (see link). If the link doesn't work, use the words below in the search box.

        I owed a considerable amount the first year after filing ch13 and the IRS would not enter into an agreement, but I was allowed to send in payments as I was able to. Even though I sent a couple payments it was paid mostly by offsets from the following years and now that I am nearing the end of my bk13 plan we are IRS debt free. Thank goodness.

        jmac was fortunate and I would not bank on your trustee to pay the IRS. If there is a provision I am not aware of it.
