    Final payment?

    Hi all,

    We recently mailed, what we believe, is our last chapter 13 payment. We began making payments prior to being confirmed, so the court ordered payment date is not helpful. We completed our consumer credit counseling as well. Is there some way to determine if it is truly our last payment? I checked PACER and the National Database Ctr. but couldn't find anything helpful. Am I missing something on those websites? I'm not sure if our lawyer would even be able to tell us, as our case was such a long drawn out battle. Thx for your help.

    Why not call the trustee? I found that the trustee's office was quite helpful in answering questions like this when I approached the end of my 13. But my situation may have been an exception after reading some of the horror stories posted.

      Thx but I'm a little "gun shy" about contacting the trustee. She gave us such a hard time in the beginning and we have been flying under the radar since. I don't want to do/say anything that would make her look at our case again. Not that we have anything to hide but we're just afraid of her in general.

        Even though an inquiry as to how many payments remain should be harmless, I don't think anyone who has an attorney should call the trustee unless instructed by their attorney to do so. The trustee may be helpful, but unlike your attorney, she is not your advocate and it is not her job to protect your interests. Your attorney should be able to answer your question no matter how big a battle it was to get the plan confirmed. Call him. This is what you paid him for.

        On NDC, on the case summary, does it show a plan base and the amount paid? In my case, that was always accurate. The difference between my base and amount paid was the total amount of the remaining payments. But, from what I've read here, not all trustees keep the NDC data current. So, don't panic if it doesn't show what you expect it to show. You can also look at your confirmed plan to see how many payments it required and compare that to the ledger on NDC.

          I'm just 2 payments behind you! About 3 months ago I started getting nervous about my payment accounting being correct, so I searched through all the payments on NDC, then wrote an email to the trustee saying, "I show us having 5 payments remaining on our Chapter 13. Would you please confirm that is correct?" That same day I received a reply confirming the number of payments remaining, plus an unexpected congratulations from him on being so close to completing something that many don't. And to think I was trying to lay low and hide from him this whole time!

            Thanks guys! I took your advice, Lady, and discovered that it was indeed our last payment! To be on the safe side, I will call our attorney to confirm. Can't wait to put this all behind us! And yes dddouggg, I understand about laying low from the trustee! I don't need to draw any unwanted attention our way! Congrats on being almost done. Those last few months will fly by. We made sure we had enough saved so that we could pay the final year in case something unexpected happened, which it did! My husband had open-heart surgery and has been off of work for the last two months! So glad we thought ahead. Hopefully the next time you hear from me it will be celebrating our discharge! Thx again.
