    Chapter 13 After Chapter 7

    Good Evening! I have a question about filing Chapter 13 after filing Chapter 7.

    A little over 3 years ago my husband lost his job with the sequestration. We sold our house, moved to a place with more employment and filed bankruptcy. It was discharged in December 2013.

    Then my husband was working here and lost his position. We quickly racked up credit card debt. We are now both working but can't afford everything.

    Does anyone know if you can file Chapter 13 3 years after filing for Chapter 7?

    To get a discharge of your debt, you have to wait 4 years after filing the Chap 7 to file a Chap 13. But, you can file Chap 13 earlier in order to allow you to pay off your debt at a rate you can afford over 3 to 5 years, without paying interest on unsecured debt. It can be a good tool to allow you some breathing room to get your debts paid off.
