    Late paying mortgage during 13. Help

    Filed in PA 5 years ago for Ch 13
    Just made final payment to trustee
    Issue I am worried about is I lost my
    Job for about 8 months halfway through
    Chapter 13. Plan
    I was able to pay the trustee payment
    But I was unable to Pay my regular mortgage
    To Wells Fargo for 12 months They never once notified the trustee or My
    Lawyer I was so late

    Just got letter from trustee basically saying
    Wells Fargo has 21 days to object to discharge

    Will they rat me out and my case thrown out
    Or is Wells Fargo such a mess they won't
    Even respond or object

    I' have a 130k lien strip on the line

    Cant wait another 2 to 3 weeks

    Anyone have thoughts ?

    The Trustee probably filed a Notice of Cure basically stating that all PRE PETITION mortgage arrears have been paid. Wells Fargo will probably file a response indicating that it either agrees or disagrees with the Notice. If you have made all of your Plan payments and the arrears paid through the Plan matches the arrears listed on the Proof of Claim filed by WF then the lender will most likely file a statement that it "agrees" with the Notice (or nothing at all). This should have nothing to do with POST PETITION mortgage payments.

    You need to sit down with your lender and work out a way to fix the POST PETITION default if you want to keep your home. Maybe try for a loan modification. Burying your head in the sand for a full year is not going to make the issue go away if you want to stay in your home. Once that discharge is entered WF is going to move forward with foreclosing.
