Okay, I have decided to reuse my VA Home Loan Certificate on a property that I wanted last year. We received permission from the Trustee to incur debt with an updated family budget last year 2016 but got denied by Navy Federal Credit Union. I was told today again from Navy Federal Credit Union that our Title still had a Second Mortgage which had an ACTIVE JUDGEMENT but the Lien from CitiFinancial/ONEMAIN was removed. I went to the County Title and Deeds office to find out what was going on and called my attorney. Sure enough this was the reason for denying my Veterans Administration 100% Cash Out Refi by 3 different companies.

I am now 12 days out from getting my discharge, but I have 23 June 2017 to close on the home......... this judgement must be removed by the 31st of May or I loose the home of my dreams. Fighting lazy Mortgage Loan Brokers who do not want to "MANUALLY" underwrite a loan because of the CH13 and being LIED to about having to wait 1 year after being discharge for a VA HOME LOAN is really frustrating. The underwriter from NFCU is AWESOME and has promised that my loan WILL BE GOOD TO GO as long as I can verify that I HAVE NOT MISSED ANY PAYMENTS DURING THE CHAPTER 13! and baby!

So, yes the second mortgage was STRIPPED after reviewing my documentation and now I will ensure that my awesome attorney will get this removed by 1 June.

      Phew, I need a beer!

You deserve a beer. I can tell that you are a person who charges towards the gunfire. I like that you persevered and you're an inspiration to the rest of us.

Quick update in regards to the 2nd mortgage from CitiFinancial. The judgment is still showing and after talking to the Citi Bankruptcy Recovery department, I was not happy at all. As I stated previously, March 2016 the Lien was removed from my title and deed however; the original judgment that was put on my title and deed in General Sessions Court is still preventing me from getting my mortgage on the second home through Navy Federal Credit Union. I was approved all the way until the Title and Loan Company that is preparing our documents informed the lender that we still had a judgment against the current home. I've sent the original letter and 1099C to Navy Federal Credit Union and was still denied by the Underwriting Team in Virginia. Can I sue for financial damages for CitiFinancial not releasing the judgment a year after the lien was satisfied?

Just lost the house of our dreams just in the home stretch! HELP! lol

I don't know what you should do, but to work through the process. A creditor could hold a judgment even if they release the mortgage lien (or deed of trust). The judgement itself may be a deficiency judgment and not a mortgage lien. That's probably why NFCU wants to see the judgment released because they want clean title or marketable title in order to issue a warranty deed. Only the creditor can release the judgment or record a satisfaction of the judgment.

I do not know what recourse you have but CitiFinancial definitely the place where the inquiry starts and ends. What did CitiFinancial say that made you not happy at all?
