    Trustee objected to motion to allow withdrawl of funds from tsp for dental

    I asked my attorney to file a motion requesting that my trustee grant permission for me to withdraw $ 3,500 from my TSP for some dental work. Today - on the last day to object - she did just that. I am so upset. I need to get this work done and I have no idea how it will happen now.

    Basically, she is saying that since we have VA income we should have money in savings. I just got off a 40 day government shutdown and now it's xmas time. I wish we did have it in savings but we just dont.

    Has anyone had this happen...what happens now?

    I haven't had this happen, but an objection by the Trustee just means that it goes to the judge. The judge will either have your attorney and Trustee work it out, or it will go to an evidentiary hearing. Since you're in a Chapter 13, having otherwise exempt income (VA) doesn't necessarily mean you have gobs of money laying around in savings.

    So, wait for the hearing (probably a non-evidentiary hearing at first), see if the Trustee bends. Then take it to a full hearing and have the judge determine the outcome.
