I filed a chapter 13 under the new laws and was wondering if any debtors have been requested by their trustee to submit tax returns during their bankruptcy? and/or updated schedules I and J?
Thanks
I'm in Michigan and under the new laws also. The booklet we received from the Trustee states that you have to send in your tax returns each year, whether you get a refund or not. In our case we will owe approximately $600. There was nothing stated about updating the schedules. ( Hopefully that isn't something they are going to ask for every year! ) I do think though that their specification of "even if you don't get a refund" means that if they see an increase in income that they will want the payments increased.
I'm interested to see how all of this plays out in the coming year for us "new law" filers.
Filed Chapter 13 02/2006 - Confirmed 05/2006 - Discharged 09/2011 I'm not an attorney. My replies are merely suggestions or observations, not legal advice. As always, consult with an attorney before making any decisions.
Our trustee sent us a letter stating he expects to receive a copy of our 2006 tax returns before May 1 or he will dismiss our case. We just did our taxes and are getting a total of $1500 back from federal and two states (we work in one state and live in another). We expect our trustee is going to take the entire $1500 - if he doesn't, then won't that be a lovely surprise?
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
