trustee says some credit cards are joint

one reason why ours is being objected to is because some of the credit cards that are listed as individual are listed as joint on the credit report. our lawyer says if my husband never used them we could sign an affidavid to that fact and submit that to the trustee. anyone else have this problem? I would think it would open up a can of worms with the creditors, wouldn't it just be easier to include it into the program??

UPDATE:

our confirmation hearing was continued so as to allow the creditors to make claims for the ones in question that were reported by me as individual when the trustee says joint. it's continued till after the claims bar date.

however, it's very interesting to note that according to pacer some of those claims are now coming in that are in question and they are coming in AS I SAID..............INDIVIDUAL claims...............so if anything this most definately shows that I AM a truthful person.....I think the ones they were really concerned with have come back as I stated. so this thing should confirm before the hearing date.

Glad to hear things are working out for you, QS. I still think your trustee is barking up a very odd tree harping on the "individual vs. joint" payback % differences when for the vast majority of Ch 13 filers, there is no difference at all. There's no mention of this anywhere in the code, so this is likely a local custom, or could be a new trustee just learning the ropes. Sounds like the outcome will be fine for you, and that's what matters.
