    house payment

    I received notice in December 06 that my mortgage payment would go up in January (approx $30). In January, and February trustee paid old amount, I spoke with trustees office and they said because so many change in January, they were running behind and would catch up. March came and they paid the old amount. I spoke with trustees office again today and they said they still had old amount listed.

    I contacted the mortgage company (citimortgage) and they said they had been receiving and applying the old amounts. The first rep asked me to get a fax number for the trustees.

    I got the # called back and the different rep (of course) had me hold and came back that the lit group would send a notice of increase to trustee not to worry.

    Well this is my home and the only reason I filed bankruptcy was to save it. There is enough money in my 13 account to pay the new amount and make up the differences of the past months as all other claims have been paid and the trustee has been leaving the extra in there.

    I havent called my attorney yet because I do not want to incur more fees, but I am coming down the homestretch (about 6 months) to go and I do not want to come out of bankruptcy and find out I owe a lot of fees and late charges on my mortgage.

    Should I wait and see what happens with April payment or should I go ahead and get my attorney involved.

    Call and let your attorney know what is going on. He/she can't help you if they don't know you need help. Share the three-month-long history of your interactions with the trustee's office and that they have not yet sent the right mortgage payment despite promises to do so. As you said, you filed to save your house - why invite problems now so close to the finish line?

      It's not your mortgage payment, it's your trustee's. Mortgage co. should notify trustee about increase payment not you and they know that
