    Need your prayers

    We filed Chapter 13 Feb 15th. Our 341 is April 10th. I had some feelings that the taxes taken out of my husbands check was not enough since we are now renting not buying and can't claim that deduction. I was right to the tune of $650 a month. We have already turned in our plan proposal of course. I've tried reaching my attorney....talked with her associate on Friday and have not heard anything back. I'm getting a letter from my accountant confirming this. Problem: my payment was only 1% to unsecureds the rest pays cars and taxes. So I am already worried over this when...

    today my husband went to the dr for a severe headache he's had for awhile along with some trouble talking and walking straight. He was sent asap for a cat scan which shows a "lower cerebellum protrusion" Going to neurologist tommorrow. I don't know what this means.

    I know that my husband being ok is the main thing right now. I'm so afraid. I don't work right now b/c of previously being self employed but having a herniated disc. I'm overwhelmed with "what am I going to do" thoughts. All the "what if's" I was already at the point of breaking but now.... I have to be strong for my husband.

    sorry for the pity party. I just don't know what the bankruptcy changes will be and more importantly I am in limbo with my husband. I'm just lost right now.

    Don't worry about having a "pity party"!!!

    That's what we're here for. To help support each other, share information, and SUPPORT each other.

    Your first concern is your Husband's health. Hopefully that will be taken care of. That your Husband will fully recover and everything will be OK with his health.

    Worry about the BK later. Right now, focus on your Hubby!!

      So sorry to hear about your troubles, dovette - you must be sick with worry. I'm a former critical care nurse - what the CAT scan showed is something unexpected in the base of your husband's brain - see http://cmgm.stanford.edu/~pbrutlag/p...t/mm/text.html for an simple illustration if you aren't sure where the cerebellum is. As the neurologist follows up with more tests, they will be able to tell the two of you more about what they need to do to find out more about what the problem might be which will then determine what kinds of treatments (if any) they will recommend.

      No matter what happens, remember that when there is a problem, it's always best to catch it early, and by going to the doctor, your husband has done just that. Also remember that we will be here for you whenever you need us for venting, hand-holding, whatever.           You have every right to be concerned and no, you are not having a pity party! I can definitely empathize as my husband had major surgery last summer and some unexpected challenges with that. He is okay now, but I do know the toll it takes on you. Take care of yourself, your husband, and be assertive with the lawyer.

          And PLEASE, vent anytime. Goodness knows, the wonderful folks here have been there for me when I needed to vent, rant and rave, etc.

          Keep us posted on what the doctor says!

            update

            My husband went to neurologist who had him go asap to get mri. It was normal....yeah! He thinks it could be a migraine? If he's not better tommorrow then he will do a spinal tap. He's in so much pain right now.
            Hopefully he'll be better tommorrow.

            On the bankruptcy, I had left 4 messages for my attorney to call me regarding the tax issues on the bankruptcy (since last Thursday) She never called. Today I got on pacer and she filed an amendment changing 2 things I knew about, lease and a line on statement of financial affairs. However there was a change on monthly income and disposable income. Even if this was a correct change, shouldn't she have gone over this with me before filing it? I hope I haven't gotten into trouble with this lawyer. I emailed her and her boss asking for a call in the morning to discuss all this as I am now unsure and afraid.

              I hope your hubby is feeling better tonight. I know that migraines can last for days and be quite horrible. My father suffered with them and I remember how horrible he said they were.

              This forum is awesome and I have had wonderful support from the people on here. I know I would have not survived bk if not for them. I won't answer your question because I was a straight chapter 7. There are folks on here that are quite educated about the 13's.

              Anyway, take good care of hubby!

                So happy that the MRI was normal, dovette! Hope your husband finds relief from his pain very soon.

                About your concern regarding your lawyer.....after the initial discussions and filing are done, it isn't unusual for a Ch 13 lawyer to file amendments that you have requested without having you come into the office or call about them first. In our case, our lawyer filed a hearing request with our bk court to force our mortgage company to put up or shut up regarding their objection stating we were a month in arrears when we filed (and we weren't). We knew he planned to do it - we just weren't sure when. We found out that he filed the papers when we received our copy of the legal papers in the mail. (We won, by the way - the bk judge threw our mortgage company's objection out last month!)

                Were the amendments that your lawyer filed for your case accurate?

                  Well if your hubby does have migraines I feel his pain, literally. I suffer some pretty horrible ones, immensely painful those things are.

                  I actually started taking Excedrin Migraine (couldn't afford my RX anymore) and they work. My migraines would get so bad I had to give myself a shot to get rid of them. No more, the second I feel a headache coming on, I pop an EM and they're gone about 90% of the time. The times they aren't my RX probably wouldn't have helped either because sometimes it didn't do the trick.

                  Tell him to lie still in a darkened room for as long as it takes - that's the only other method I have to get rid of them. I hope he feels better VERY soon!

                    So glad that the MRI was normal. But, migraines are terrible!! Thankfully, I don't have them very often, but had one last weekend that was one of my worst ever! The best treatment for me is to go to sleep. I took my Imitrex and it seemed to make it worse so I took two muscle relaxers and took a good nap and was fine. The barometric pressure, fatigue, and certain smells trigger mine. (Too bad it isn't food as I need to go on a serious diet )

                      Cancel or delay the bankrupcty if you can?

                      Unless you have 100% coverage, you are going to also be facing huge medical bills which would be unsecured. How is that dealt with after the start of a bankruptcy?

                        Medical bills that come after filing Ch 13 do have to be paid back....but if they impact your ability to make your monthly payment, your Ch 13 lawyer can file an amended plan to include paying back the new debt.

                        And Samantha, it's terrible advice to suggest to dovette to "cancel or delay" her filing (they already filed - read her first post). To suggest in your post title that she dismiss her case is the worst possible thing she could do! Please be very careful about what you recommend if you aren't familiar with the complex ins and outs of Ch 13, especially under the new bk law. Posters take the suggestions offered here seriously, especially if they are new to the bk scene. Better to stay quiet unless you are certain what you suggest is the right thing to do - thanks!
